A person intending to engage in industrial hemp growth,\n\ncultivation, handling, or processing authorized under the Oklahoma\n\nIndustrial Hemp Program shall apply to the Oklahoma Department of\n\nAgriculture, Food, and Forestry for a license prior to planting,\n\nhandling, or processing the industrial hemp.\n\n1. The application shall include:\n\na. the name and address of the applicant,\n\nb. the legal description, global positioning system\n\nlocation, and map of the land area on which the\n\napplicant will engage in industrial hemp growth and\n\ncultivation operations, handling operations or\n\nprocessing operations,\n\nc. a statement of intended end use, and\n\nd. a criminal history record check for all key\n\nparticipants submitted with the initial or renewal\n\napplication.\n\n2. By submitting an application, the applicant acknowledges and\n\nagrees that:\n\na. information provided to the Department may be provided\n\nto law enforcement agencies,\n\nb. the applicant shall allow and fully cooperate with any\n\ninspection and sampling that the Department deems\n\nnecessary,\n\nc. the applicant will submit all required reports by the\n\napplicable due dates specified by the Department, and\n\nd. the applicant has the legal right to cultivate, handle\n\nor process industrial hemp on the registered land area\n\nand shall grant the Department access for inspection\n\nand sampling.\n\nB. The Department shall collect a nonrefundable fee from the\n\napplicant at the time of application. The Department shall set a\n\nfee schedule based on the size and use of the land area on which the\n\nlicensee will conduct industrial hemp growing or cultivation\n\noperations and shall set the fee at a level sufficient to generate\n\nthe amount of monies necessary to cover the Department’s direct\n\ncosts in implementing the Oklahoma Industrial Hemp Program. Denied\n\napplications for a license may be resubmitted within a twelve-month\n\nperiod. The Department may waive the fee for resubmitted\n\napplications.\n\nC. A license issued pursuant to this section is valid for one\n\n(1) year. In order to continue engaging in industrial hemp growth\n\nand cultivation operations in Oklahoma, the licensee shall annually\n\napply for a license in accordance with subsection A of this section.\n\nThe Department may set a separate fee schedule for renewal of\n\nexisting licenses in good standing.\n\nD. All industrial hemp plant material shall be planted, grown\n\nand harvested under a valid license. Any plant material that is not\n\nharvested in the license period in which it was planted or volunteer\n\nplants that are not destroyed must be declared for inclusion in a\n\nsubsequent license.\n\nE. If the licensee wishes to alter the land area on which the\n\nlicensee will conduct industrial hemp growth, cultivation, handling\n\nor processing operations within thirty (30) days of any new license,\n\nbefore altering the area, the licensee shall submit to the\n\nDepartment and the United States Department of Agriculture Farm\n\nService Agency an updated legal description, global positioning\n\nsystem location, and map specifying the proposed alterations.\n\nF. Each licensee shall report any changes to information\n\nprovided in the license application within ten (10) days of such\n\nchange to the Department and the United States Department of\n\nAgriculture Farm Service Agency.\n\nG. A licensee shall maintain all records pertaining to the\n\nlicense and growing records for a minimum of three (3) years.\n\nH. The Department shall promulgate rules necessary to implement\n\nthe licensing program and to implement the Oklahoma Industrial Hemp\n\nProgram.\n\nI.
