Any plants of the licensee are subject to at least annual\n\nroutine inspections and sampling to verify that the plant meets the\n\ndefinition of industrial hemp. The Department shall notify each\n\nlicensee of the scope of the inspection and the process by which the\n\ninspection will be conducted. The Department shall promulgate rules\n\nregarding the procedures of inspection and sampling.\n\nB. The Department may inspect and take samples from any\n\nlicensee’s plants during normal business hours.\n\nC. Licenses for handling or processing shall be subject to at\n\nleast annual inspections in addition to compliance inspections.\n\nD. The Department shall have the licensee present at the time\n\nof inspection and sampling. The licensee or authorized\n\nrepresentative shall provide the Department’s inspector with\n\ncomplete and unrestricted access to all plants, parts and seeds,\n\nwhether growing or harvested, and all land, buildings and other\n\nstructures used for the growth, cultivation, harvesting, storage,\n\nhandling or processing of industrial hemp, and all documents and\n\nrecords pertaining to the licensee’s industrial hemp-growing,\n\ncultivation operation, handling and processing.\n\nE. The licensee shall pay for any inspection and laboratory\n\nanalysis costs that the Department deems necessary within thirty\n\n(30) days of the date of the receipt of an invoice for the costs.\n\nThe Department shall waive all inspection or sampling costs if no\n\ninconsistencies or violations are identified during an inspection\n\nthat is not part of the regular annual inspection process.\n\nF.
