The assessment imposed pursuant to the provisions of the\n\nBoll Weevil Eradication Act shall be levied on a cotton grower at\n\nthe time of sale and shall be collected and remitted to the board of\n\ndirectors by the cotton gin serving as the selling agent for the\n\ncotton produced. The cotton gins shall furnish monthly reports to\n\nthe board of directors on or before the fifteenth day of each month\n\nregarding the assessments collected, pay all of the assessments\n\ncollected each month, and furnish the board with any other\n\ninformation reasonably requested by it to ensure the collection of\n\nthe assessments for each grower.\n\n2. Pursuant to the provisions of the Boll Weevil Eradication\n\nAct no cotton shall be subject to assessment of a fee more than\n\nonce.\n\nB. 1. The cotton gin serving as selling agent for the cotton\n\ngrower shall collect the assessment in the same manner as ginning\n\ncosts are deducted from the purchase price of the cotton or from any\n\nfunds advanced for that purpose.\n\n2. The board of directors, by registered or certified mail,\n\nshall notify each cotton gin of the duty to collect the assessment,\n\nthe manner in which the assessment is to be collected, and the date\n\non or after which the cotton gin is to begin collecting the\n\nassessment, the date by which an accounting of all assessments\n\ncollected and paid will be submitted, and the date by which the\n\nbalance of previously collected assessment shall be paid.\n\n3. The amount of the assessment collected shall be clearly\n\nshown on the sales invoice or other document evidencing the\n\ntransaction. The cotton gin, as the seller's agent, shall furnish a\n\ncopy of the document to the cotton grower.\n\nC. 1. The cotton gin may rely upon the information or\n\ncertification provided by the board of directors to the cotton gin\n\nregarding cotton acres and other related information as deemed\n\nnecessary by the board of directors in determining the amount of\n\nassessment due and owing from the cotton grower.\n\n2. A cotton gin that uses due diligence in collecting an\n\nassessment from a cotton grower based upon information or a\n\ncertification provided by the board of directors regarding the\n\ncotton grower shall be relieved of any liability for any errors or\n\nomissions in the assessment should it be determined that the\n\nassessment was inaccurate.\n\n3. The provisions contained in this section apply to all cotton\n\ngins located in the State of Oklahoma or in any other state. Any\n\ngin that, whether by design or inadvertent act, fails to forward to\n\nthe board of directors by June 1 of each year an accounting of all\n\nassessments collected and paid, as well as payment for all\n\nassessments previously collected but not paid, shall be subject to\n\nan administrative penalty or fine pursuant to the Boll Weevil\n\nEradication Act.\n\nD. Every cotton grower shall keep accurate production records\n\non the amount of cotton ginned and the number of acres planted and\n\nharvested for a minimum of two (2) years. Copies shall be furnished\n\nto any authorized agent of the board of directors or the State Board\n\nof Agriculture at any time during reasonable business hours of the\n\ncotton grower immediately upon oral request, or within ten (10)\n\nworking days of any written request.\n\nE.
