Every pesticide or device distributed, sold, or offered for\n\nsale within this state or delivered for transportation or\n\ntransported in intrastate or interstate commerce shall be registered\n\nwith the Board.\n\nB. The registrant shall file with the Board a statement\n\nincluding, but not limited to:\n\n1. The name and address of the registrant and the name and\n\naddress of the person whose name shall appear on the label, if other\n\nthan the registrant;\n\n2. The name of the pesticide or device;\n\n3. A complete copy of the labeling accompanying the pesticide\n\nor device and a statement of all claims to be made for it, and\n\ndirections for use; and\n\n4. If requested by the Board, a full description of the tests\n\nmade and the results upon which the claims are based. In renewing a\n\nregistration, a statement shall be required only with respect to\n\ninformation which is different from the information furnished when\n\nthe pesticide or device was last registered.\n\nC. Each registrant shall pay to the Board an annual\n\nregistration fee of Two Hundred Ten Dollars ($210.00) for each\n\npesticide or device label registered. These fees shall be used by\n\nthe Oklahoma Department of Agriculture, Food, and Forestry for\n\npurposes of administering pesticide management programs. A portion\n\nof these fees, in the amount of Three Hundred Thousand Dollars\n\n($300,000.00) annually, shall be dedicated for conducting programs\n\nfor unwanted pesticide disposal. This amount shall be deposited\n\ninto the State Department of Agriculture Unwanted Pesticide Disposal\n\nFund and shall be dedicated for this use only.\n\nD. The Board may require the submission of the complete formula\n\nof any pesticide. Trade secrets and formulations submitted by the\n\nregistrant may be kept confidential. If it appears to the Board\n\nthat the composition of the pesticide is adequate to warrant the\n\nproposed claims and if the pesticide, its labeling, and other\n\nmaterial required to be submitted comply with the requirements of\n\nthis section, then the pesticide shall be registered.\n\nE. If it does not appear to the Board that the pesticide or\n\ndevice is adequate to warrant the proposed claims for it or if the\n\npesticide or device, its labeling, and other material required to be\n\nsubmitted do not comply with the provisions of this section, it\n\nshall notify the applicant of the deficiencies in the pesticide,\n\ndevice, labeling, or other material required and afford the\n\napplicant an opportunity to make the necessary corrections. If the\n\napplicant claims, in writing, that the corrections are not necessary\n\nand requests in writing a hearing regarding the registration of the\n\npesticide or device, the Board shall provide an opportunity for a\n\nhearing before refusing to issue the registration. In order to\n\nprotect the public, the Board may at any time cancel the\n\nregistration of a product or device. In no event, shall\n\nregistration of a pesticide or device be considered as a defense or\n\nexcuse for the commission of any offense prohibited under this\n\nsection.\n\nF. The Board may require that pesticides be distinctively\n\ncolored or discolored to protect the public health.\n\nG.
