Stat. tit. 2, § 2-3-82I","heading":"Pesticide producer establishment producer permit —","body":"Duration — Renewal.\n\nA. As used in this section:\n\n1. \"Establishment\" means any site where a pesticide product,\n\nactive ingredient, or device is produced within the state;\n\n2. \"Produce\" means to manufacture, prepare, propagate,\n\ncompound, or process any pesticide or to package, repackage, label,\n\nrelabel, or otherwise change the container of any pesticide or\n\ndevice; and\n\n3. \"Producer\" means any person who produces, manufactures,\n\nprepares, compounds, propagates, or processes any active ingredient,\n\npesticide, or device as used in producing a pesticide.\n\nB. It shall be unlawful for any person to produce within this\n\nstate any pesticide, active ingredient, or device without first\n\nobtaining a pesticide producer establishment permit issued by the\n\nBoard.\n\nC. The permit shall be issued only upon application on a form\n\nprescribed by the Board. The application shall contain information\n\nregarding the proposed operation of the applicant and other\n\ninformation as specified by the Board. If at any time there is a\n\nchange of the information provided in or on the application for a\n\npesticide producer establishment permit, the producer must notify\n\nthe Board in writing within thirty (30) calendar days of the change.\n\nD. The producer shall file a statement with the Board including\n\nbut not limited to:\n\n1. The name and address of the company;\n\n2. The name and address of the establishment as well as the\n\nphysical location, if different than the mailing address;\n\n3. The name of any pesticide, active ingredient, or device; and\n\n4. The name and address and other pertinent contact information\n\nfor the responsible party.\n\nE. All permits for pesticide producer establishments shall be\n\nissued for a period of one (1) year and shall be renewed annually.\n\nAll permits shall expire on June 30 each year and may be renewed\n\nwithout penalty if a properly completed application is filed with\n\nthe Board not later than the fifteenth day of the month first\n\nfollowing the date of expiration. If the application is not\n\nreceived by that date, a penalty of twice the amount of the renewal\n\nfee shall be charged for renewal of the permit.\n\nF. Each pesticide producer establishment location engaged in\n\nthe production of pesticides, active ingredients or devices shall\n\nrequire a separate permit.\n\nG. The annual permit fee for a pesticide producer establishment\n\nshall be One Hundred Dollars ($100.00) for each location.\n\nH. If requested by the Board, a complete copy of all labeling,\n\nMaterial Safety Data Sheets, technical information associated with\n\nthe pesticide, active ingredient, or device and a statement of all\n\nclaims to be made as well as directions and use must be submitted to\n\nthe Board.\n\nI. In order to determine compliance with state and federal\n\nlaws, the Board may request a full disclosure of inventory records,\n\nsales and distribution records, and any other information deemed\n\nnecessary by the Board.\n\nJ. Every producer shall keep accurate records pertaining to\n\npesticide, active ingredient, or device production and distribution\n\nas required by the Board. The records of the producer shall be kept\n\nintact at the principal producing location in this state for at\n\nleast two (2) years after the date of production and distribution\n\nand copies shall be furnished to any authorized agent of the Board,\n\nimmediately upon request in person, at any time during the regular\n\nbusiness hours of the producer.
