The Oklahoma Department of Agriculture, Food, and Forestry\n\nshall be the official animal identification agency of the state and\n\nshall be the official agency of the state in any dealings between\n\nthis state and the United States Department of Agriculture, any\n\nother federal agency, or any agency or person of this or another\n\nstate on matters pertaining to animal identification.\n\nB. It is the intent of the Oklahoma State Legislature to direct\n\nand authorize the Oklahoma Department of Agriculture, Food, and\n\nForestry to develop, implement, and administer an Oklahoma Animal\n\nIdentification Program that achieves the following goals:\n\n1. Enhance disease preparedness by rapidly identifying animals\n\nexposed to disease, thus allowing quick detection, containment, and\n\nelimination of disease threats;\n\n2. Promote continued confidence in animal products and to\n\nprotect the health status of Oklahoma’s herds and flocks;\n\n3. Identify infected and exposed premises, animals, and groups\n\nof animals;\n\n4. Develop a comprehensive infrastructure that utilizes state-\n\nof-the-art national and international standards with the best\n\navailable and practical technologies for the collection and\n\nrecording of livestock and food animal movements; and\n\n5. Be dynamic and flexible, and incorporate new and proven\n\ntechnologies as they become available.\n\nC. The Department shall be authorized to promulgate rules for\n\nthe implementation and administration of the Oklahoma Animal\n\nIdentification Program, if one of the following occurs:\n\n1. The United States Department of Agriculture issues proposed\n\nor final rules or requirements for the implementation of a national\n\nanimal identification or premises registration program;\n\n2. The United States Congress enacts requirements for a\n\nnational animal identification or premises registration system; or\n\n3. Another state establishes requirements for animal\n\nidentification or premises registration affecting the importation of\n\nlivestock from Oklahoma.\n\nD. Any rules promulgated by the Department pursuant to this\n\nsection that may be reasonably necessary to implement the Oklahoma\n\nAnimal Identification Program may include the following:\n\n1. Premises identification;\n\n2. Individual animal identification;\n\n3. Group and lot animal identification;\n\n4. Specifications and standards for the identification\n\ntechnologies used to track and trace animal movements;\n\n5. Record keeping; and\n\n6. Protecting and improving the health of Oklahoma livestock\n\nand food animals.\n\nE. The Department may charge fees; however, the fees shall be\n\nlimited to the actual costs of the Department for the implementation\n\nand administration of the Oklahoma Animal Identification Program.\n\nF. Pursuant to this section and rules promulgated pursuant\n\nthereto, any data or records provided to the Department by persons\n\nregarding premises or animal identification, including the name and\n\naddress of the provider, shall be kept confidential except in the\n\nfollowing circumstances:\n\n1. Federal law requires the information for a National Animal\n\nIdentification program;\n\n2. The Department deems release of confidential information to\n\nother state and federal agencies is necessary for disease control\n\nand disease traceback;\n\n3. The information is needed to assist law enforcement\n\nofficials in livestock recovery and theft investigations; and\n\n4. The Department may release information as needed to assist\n\nin criminal investigations or tracebacks concerning violations of\n\nstate or federal pharmacy acts and drug residues.\n\nG. In the event that information regarding premises or animal\n\nidentification is provided to other individuals or entities, the\n\ninformation shall be specific and not cumulative.\n\nH.
