A person commits an offense if, without the consent of\n\nthe owner, the person acquires or otherwise exercises control over\n\nan animal facility, an animal from an animal facility, or other\n\nproperty from an animal facility with the intent to deprive the\n\nowner of such facility, animal, or property and to disrupt or damage\n\nthe enterprise conducted at the animal facility.\n\n2. A person commits an offense if, without the consent of the\n\nowner, the person acquires or otherwise exercises control over a\n\ncrop facility, a crop from a crop facility, or other property from a\n\ncrop facility with the intent to deprive the owner of such facility,\n\ncrop, or property and to disrupt or damage the enterprise conducted\n\nat the crop facility.\n\nB. 1. A person commits an offense if, without the consent of\n\nthe owner, the person damages or destroys an animal facility or\n\ndamages, frees, or destroys any animal or property in or on an\n\nanimal facility with the intent to disrupt or damage the enterprise\n\nconducted at the animal facility and the damage or loss thereto\n\nexceeds Five Hundred Dollars ($500.00); or\n\n2. A person commits an offense if, without the consent of the\n\nowner, the person damages or destroys a crop facility or damages or\n\ndestroys any crop or property in or on a crop facility with the\n\nintent to disrupt or damage the enterprise conducted at the crop\n\nfacility and the damage or loss thereto exceeds Five Hundred Dollars\n\n($500.00).\n\nC. 1. A person commits an offense if, without the consent of\n\nthe owner, the person damages or destroys an animal facility or\n\ndamages, frees, or destroys any animal or property in or on an\n\nanimal facility and the damage or loss thereto is Five Hundred\n\nDollars ($500.00) or less or enters or remains on an animal facility\n\nwith the intent to disrupt or damage the enterprise conducted at the\n\nanimal facility, and the person:\n\na. had notice that the entry was forbidden,\n\nb. knew or should have known that the animal facility was\n\nor had closed to the public, or\n\nc. received notice to depart but failed to do so.\n\n2. For the purposes of this paragraph “notice” means:\n\na. oral or written communication by the owner or someone\n\nwith actual or apparent authority to act for the\n\nowner,\n\nb. the presence of fencing or other type of enclosure or\n\nbarrier designed to exclude intruders or to contain\n\nanimals, or\n\nc. a sign or signs posted on the property or at the\n\nentrance to the building, reasonably likely to come to\n\nthe attention of intruders, indicating that entry is\n\nforbidden,\n\n(1) a person commits an offense if, without the\n\nconsent of the owner, the person damages or\n\ndestroys a crop facility or damages or destroys\n\nany crop or property in or on a crop facility and\n\nthe damage or loss thereto is Five Hundred\n\nDollars ($500.00) or less or enters or remains on\n\na crop facility with the intent to disrupt or\n\ndamage the enterprise conducted at the animal\n\nfacility, and the person:\n\n(a) had notice that the entry was forbidden,\n\n(b) knew or should have known that the crop\n\nfacility was or had closed to the public, or\n\n(c) received notice to depart but failed to do\n\nso,\n\n(2) for the purposes of this subdivision “notice”\n\nmeans:\n\n(a) oral or written communication by the owner\n\nor someone with actual or apparent authority\n\nto act for the owner, or\n\n(b) a sign or signs posted on the property or at\n\nthe entrance to the building, reasonably\n\nlikely to come to the attention of\n\nintruders, indicating that entry is\n\nforbidden.\n\nD.
