Except as provided in subsection B of this section, an\n\nagritourism professional is not liable for injury to or death of a\n\nparticipant resulting from the inherent risks of agritourism\n\nactivities, so long as the warning contained in Section 4 of this\n\nact is posted as required and, except as provided in subsection B of\n\nthis section, no participant or participant's representative can\n\nmaintain an action against or recover from an agritourism\n\nprofessional for injury, loss, damage, or death of the participant\n\nresulting exclusively from any of the inherent risks of agritourism\n\nactivities. In any action for damages against an agritourism\n\nprofessional for agritourism activity, the agritourism professional\n\nmust plead the affirmative defense of assumption of the risk of\n\nagritourism activity by the participant.\n\nB. Nothing in subsection A of this section prevents or limits\n\nthe liability of an agritourism professional if the agritourism\n\nprofessional does any one or more of the following:\n\n1. Commits an act or omission that constitutes negligence or\n\nwillful or wanton disregard for the safety of the participant, and\n\nthat act or omission proximately causes injury, damage, or death to\n\nthe participant;\n\n2. Has actual knowledge or reasonably should have known of a\n\ndangerous condition on the land, facilities, or equipment used in\n\nthe activity or the dangerous propensity of a particular animal used\n\nin such activity and does not make the danger known to the\n\nparticipant, and the danger proximately causes injury, damage, or\n\ndeath to the participant.\n\nC.
