The Department shall administer the provisions of the\n\nHealthy Food Financing Act.\n\nB. The Department may contract with one or more nonprofit\n\norganizations or community development financial institutions to\n\nadminister this program through a public-private partnership.\n\nC. The Board shall adopt the rules and program eligibility\n\nguidelines necessary to enforce and administer the Healthy Food\n\nFinancing Act, including an application process for financing and\n\ngrants. Projects that receive financing must be located in an\n\nunderserved community and primarily serve low or moderate income\n\ncommunities. Projects eligible for financing include:\n\n1. Construction of new grocery stores;\n\n2. Construction of small food retailers; and\n\n3. Grocery store or small food retailer renovations, expansions\n\nand infrastructure upgrades that improve the availability and\n\nquality of fresh produce and other healthy foods.\n\nD. Financing made available for projects may be expended for\n\nthe following purposes:\n\n1. Site acquisition and preparation;\n\n2. Construction costs;\n\n3. Equipment and furnishings;\n\n4. Workforce training or security;\n\n5. Pre-development costs, including market studies and\n\nappraisals;\n\n6. Energy efficiency measures;\n\n7. Working capital for first-time inventory and start-up costs;\n\nand\n\n8. For small food retailers, the acquisition or leasing of\n\nrefrigeration equipment, display shelving or other one-time capital\n\nexpenditure, at a cost of less than Five Thousand Dollars\n\n($5,000.00), for the promotion and display of perishable foods,\n\nwhich shall include a blend of dairy products, fresh produce, fresh\n\nmeats and poultry and fresh or frozen fish.\n\nE. In determining which projects shall qualify for financing,\n\nthe Department shall consider:\n\n1. The level of need of access to healthy foods in the area to\n\nbe served;\n\n2. The degree to which the project requires an investment of\n\npublic financing to progress, create and impact on access to healthy\n\nfood;\n\n3. The degree to which the project will have a positive\n\neconomic impact on the underserved community, including by creating\n\nor retaining jobs for local residents;\n\n4. The degree to which the project will participate in state\n\nand local health department initiatives to educate consumers on\n\nnutrition and promote healthier eating; and\n\n5. Other criteria the Board determines to be consistent with\n\nthe purposes of this act.\n\nF. Eligible applicants for financing shall include but are not\n\nlimited to sole proprietorships, partnerships, limited liability\n\ncompanies, corporations, cooperatives, nonprofit organizations,\n\nnonprofit community development entities, universities or government\n\nentities. Applicants for financing must:\n\n1. Demonstrate the capacity to successfully implement the\n\nproject and the likelihood that the project will be economically\n\nself-sustaining;\n\n2. Demonstrate the ability to repay the debt; and\n\n3. Agree, for a period of at least five (5) years, to comply\n\nwith the following conditions:\n\na. to accept the benefits of The United States Department\n\nof Agriculture’s Supplemental Nutrition Assistance\n\nProgram,\n\nb. to apply to accept The United States Department of\n\nAgriculture’s Special Supplemental Nutrition Program\n\nfor Women, Infants, and Children and to accept the\n\nbenefits, if approved,\n\nc. to allocate at least thirty percent (30%) of food\n\nretail space for the sale of perishable foods, which\n\nshall include fresh dairy, produce, meats, poultry and\n\nfish,\n\nd. to comply with all data collection and reporting\n\nrequirements established by the Board, and\n\ne. to promote the hiring of local residents.\n\nG. The Board may establish monitoring and compliance mechanisms\n\nfor projects receiving financing.\n\nH. The Department shall raise matching funds, promote the\n\nprogram statewide, evaluate applicants, underwrite and disburse\nroduce, meats, poultry and\n\nfish,\n\nd. to comply with all data collection and reporting\n\nrequirements established by the Board, and\n\ne. to promote the hiring of local residents.\n\nG. The Board may establish monitoring and compliance mechanisms\n\nfor projects receiving financing.\n\nH. The Department shall raise matching funds, promote the\n\nprogram statewide, evaluate applicants, underwrite and disburse\n\ngrants and loans and monitor compliance and impact.\n\nI.
