The State Board of Agriculture shall establish a program for\n\nthe certification of organic agricultural products. The Board shall\n\nsubmit this program to the Secretary of the USDA for accreditation\n\nas required by the Organic Food Production Act of 1990, as amended,\n\n7 U.S.C., Section 6501 et seq. and rules promulgated pursuant\n\nthereto. Upon accreditation, the Board shall act as a certifying\n\nagent and issue a Certificate of Organic Production to an operation\n\nthat has met all requirements of the Oklahoma Organic Food Act and\n\nrules promulgated pursuant thereto.\n\nB. The Board shall promulgate appropriate rules for the\n\nadministration of the program for the certification of organic\n\nagricultural products, including:\n\n1. Standards for the analysis, inspection, and certification of\n\nthe organic agricultural products;\n\n2. Records required of producers and handlers of organic\n\nagricultural products;\n\n3. Standards for the certification of producers and handlers of\n\norganic agricultural products;\n\n4. Lists of approved and prohibited substances for use in the\n\nproduction and handling of organic agricultural products; and\n\n5. A schedule of fees for initial certification and inspection\n\nfor continued certification as a producer or handler of organic\n\nagricultural products.\n\nC. The Board is authorized to inspect, sample, analyze, examine\n\nrecords, and test any product claimed to be organically grown or\n\ndistributed within the state to determine if the product is in\n\ncompliance with the Oklahoma Organic Food Act. The Board has the\n\nauthority to enter upon public or private property at any reasonable\n\ntime for the purpose of administering the Oklahoma Organic Food Act.\n\nAny certified operation or applicant for a Certificate of Organic\n\nProduction shall be deemed to have given consent to any authorized\n\nagent of the Board to access, enter, inspect, or monitor the\n\nproperty. Refusal to allow access, entry, or inspection shall\n\nconstitute grounds for the denial, nonrenewal, suspension, or\n\nrevocation of certification.\n\nD. The Board shall require laboratory analysis of a product\n\nclaimed to be organically grown if it has reasonable cause to\n\nsuspect the product may contain a substance not approved for organic\n\nproduction.\n\nE. All new applicants are required to have their soil-growing\n\nmedia and irrigation water, if not municipal, assayed for the\n\npresence of pesticide residues.\n\nF. Verification documents that may be required include, but are\n\nnot limited to, questionnaires, farm plans, affidavits, inspection\n\nreports, laboratory assays, and other documents to verify the path\n\ntaken by an organic food product through post-harvest handling and\n\ndistribution.\n\nG. The Board may conduct audits of all documents for\n\nverification that producers meet the requirements of the Oklahoma\n\nOrganic Food Act and rules.\n\nH. The Board is authorized to promulgate rules as necessary to\n\nadminister the Oklahoma Organic Food Act and establish certification\n\nstandards to carry out the Oklahoma Organic Food Act.\n\nI.
