A person shall not sell, offer for sale, label, or advertise\n\nan agricultural product with the representation that it is organic\n\nif the person knows or has reason to know that it has not been\n\ncertified pursuant to the Oklahoma Organic Food Act or the Organic\n\nFood Production Act of 1990, as amended, 7 U.S.C., Section 6501 et\n\nseq. and the rules and regulations promulgated pursuant thereto.\n\nB. The State Board of Agriculture is authorized to issue a\n\nwritten or printed “stop-sale” or “notice of violation” order to the\n\nowner or custodian of a product being labeled, advertised or offered\n\nor exposed for sale in violation of the Oklahoma Organic Food Act or\n\nrules promulgated pursuant thereto.\n\nC. Any person violating the provisions of the Oklahoma Organic\n\nFood Act or rules promulgated pursuant thereto may be:\n\n1. Assessed an administrative fine as specified in Section 2-18\n\nof this title; and\n\n2. Deemed guilty of a misdemeanor and, upon conviction thereof,\n\nmay be punished by a fine of not more than One Thousand Dollars\n\n($1,000.00).\n\nD.
