Any nonprofit organization authorized under the laws of\n\nthis state representing the producers of an agricultural commodity\n\nmay petition the Commissioner of the Oklahoma Department of\n\nAgriculture, Food, and Forestry for certification as the\n\norganization authorized to establish a new commodity producers board\n\nand conduct an assessment referendum pursuant to the Oklahoma\n\nAgricultural Commodity Act.\n\n2. The petition shall state:\n\na. the reasons for and the purposes of the commodity\n\nproducers board,\n\nb. the number of board members and board organization,\n\nc. propose either a six-member, nine-member, twelve-\n\nmember or fifteen-member board and whether board\n\nmembers will be appointed by district or appointed at\n\nlarge,\n\nd. the maximum assessment to be levied pursuant to an\n\nelection, and\n\ne. such other information required by the Commissioner;\n\n3. The petition shall be signed by at least twenty percent\n\n(20%) of the commodity producers in the state or at least two\n\nhundred commodity producers, whichever is less.\n\nB. 1. Any new nonprofit organization authorized under the laws\n\nof this state representing the producers of an agricultural\n\ncommodity may petition the Commissioner for approval as a successor\n\norganization authorized to replace an existing statutory commodity\n\nproducers board.\n\n2. The petition shall:\n\na. state the existing statutory commodity producers board\n\nto be replaced,\n\nb. provide the bylaws for review and approval by the\n\nCommissioner for the new nonprofit organization, and\n\nc. provide any other information required by the\n\nCommissioner.\n\n3. The petition shall be signed by a majority of the board\n\nmembers of the existing statutory commodity producers board.\n\n4. Any new nonprofit organization petitioning the Commissioner\n\nmay retain the name of the existing statutory commodity producers\n\nboard.\n\nC. 1. Within fifteen (15) days following the day on which a\n\npetition for certification is received, the Commissioner shall\n\nschedule a public hearing to consider the petition. The public\n\nhearing shall be scheduled no later than forty (40) days after\n\nreceipt of the completed petition is received by the Department.\n\n2. Upon the scheduling of the public hearing, the nonprofit\n\norganization shall provide for notification of interested commodity\n\nproducers in the manner, method and locations required by the\n\nDepartment.\n\n3. If the Commissioner determines that, on the basis of\n\ntestimony presented at the public hearing, the petitioning\n\norganization is representative of the producers of the agricultural\n\ncommodity and that the petition conforms to the purposes and\n\nprovisions of the Oklahoma Agricultural Commodity Act, the\n\nCommissioner shall:\n\na. certify that the organization is representative of the\n\nproducers of the commodity and is authorized to\n\nestablish the commodity producers board and to conduct\n\nthe board election and assessment referendum, or\n\nb. approve the new nonprofit organization as a successor\n\norganization authorized to accept the statutory\n\nassessment.","path":["OK Code","Title 2"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os2.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"0479a5a9d19388d0d7f01903c71b37dd819b8ee1d1a33a6fd1a9a812eb0b3521","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-2-2-5-60.12","next":"us-ok/okla.-stat.-tit.-2-2-5-60.14"},"notice":"GroundRules: Original legal text.
