A certified organization that does not have a statutory\n\nassessment may establish a new commodity producers board and conduct\n\nan election of members to the commodity producers board for the\n\ncommodity. The ballot shall also provide for a referendum of the\n\nproducers of an agricultural commodity on the proposition of whether\n\nor not the producers shall levy an assessment on themselves to\n\nfinance programs of research, disease and insect control, predator\n\ncontrol, education, or promotion designed to encourage the\n\nproduction, marketing, and use of the commodity. The certified\n\norganization shall give public notice of:\n\n1. The date, hours, and polling places for voting in the\n\nreferendum and election;\n\n2. The estimated amount and basis of the assessment proposed to\n\nbe collected;\n\n3. Whether a producer exemption is to be allowed in accordance\n\nwith Section 5-60.18 of this title; and\n\n4. A description of the manner in which the assessment is to be\n\ncollected and the proceeds administered and used.\n\nB. The notice under subsection A of this section shall be\n\npublished in one or more newspapers published and distributed within\n\nthe boundaries described in the petition. The notice shall be\n\npublished for not less than once a week for three (3) consecutive\n\nweeks, beginning at least sixty (60) days before the date of the\n\nelection. In addition, at least sixty (60) days before the date of\n\nthe election, the certified organization shall give direct written\n\nnotice to each county extension educator in any county within the\n\nboundaries described in the petition.\n\nC.
