The commodity producers board shall have the power and duty\n\nto:\n\n1. Employ personnel deemed necessary by the board, fix the\n\namount and manner of their compensation, and incur other expenses\n\nthat are necessary and proper to enable the board to effectively\n\ncarry out the purposes of the Oklahoma Agricultural Commodity Act;\n\n2. Adopt and amend bylaws as necessary to promptly and\n\neffectively administer the Oklahoma Agricultural Commodity Act;\n\n3. Retain legal counsel as is required to fulfill the purposes\n\nof the Oklahoma Agricultural Commodity Act;\n\n4. Sue and be sued;\n\n5. Initiate prosecution and civil remedies necessary to collect\n\nany assessments due and owing to the commodity producers board;\n\n6. Cooperate with local, state, national or international\n\norganizations, whether public or private, in carrying out the\n\npurposes of contracts as may be necessary;\n\n7. Make such reasonable expenditures of funds as is necessary\n\nto carry out the provisions of the Oklahoma Agricultural Commodity\n\nAct;\n\n8. Call and conduct such meetings and elections as may be\n\nnecessary in carrying out the provisions of the Oklahoma\n\nAgricultural Commodity Act;\n\n9. Keep minutes of its meetings and other books and records\n\nthat clearly reflect all acts and transactions of the board. The\n\nboard shall open its records to examination by any participating\n\nproducer or the Commissioner of the Oklahoma Department of\n\nAgriculture, Food, and Forestry during regular business hours;\n\nprovided, the board may determine in bylaws that certain information\n\nprovided by a commodity producer is confidential due to proprietary\n\nor privacy reasons;\n\n10. Set the rate of the assessment. The rate may not exceed\n\nthe maximum established by statute in the case of successor\n\norganization or in the election authorizing the assessment or a\n\nsubsequent election establishing a maximum rate in the case of a\n\ncertified organization;\n\n11. Deposit all monies received by the board, including but not\n\nlimited to assessments, donations, and grants, in a bank selected by\n\nthe board and invest in securities of the state or federal\n\ngovernment, certificates of deposit or certificates of any bank,\n\ntrust company or savings and loan association insured by a federal\n\nagency;\n\n12. Establish an office or headquarters as necessary;\n\n13. Purchase, lease, sell, exchange or dispose of real or\n\npersonal property;\n\n14. Formulate general policies and programs for the education,\n\ndiscovery, promotion, and development of markets and industries for\n\nthe utilization of the commodity in cooperation with the Oklahoma\n\nDepartment of Agriculture, Food, and Forestry;\n\n15. Hire or retain legal counsel to represent the board in any\n\nmatter and producers in matters pertaining to transportation\n\nproblems and other matters which could result in potential\n\nsubstantial loss to producers;\n\n16. Borrow money for any lawful purpose;\n\n17. Act separately or in cooperation with any person in\n\ndeveloping, carrying out, and participating in programs of research,\n\ndisease and insect control, predator control, education, and\n\npromotion designed to encourage the production, marketing, and use\n\nof the commodity on which the assessment is levied; and\n\n18. Exercise such other powers as necessary to carry out the\n\npurposes of the Oklahoma Agricultural Commodity Act.\n\nB. The State Board of Agriculture may promulgate rules for the\n\nestablishment of commodity producer boards pursuant to the Oklahoma\n\nAgricultural Commodity Act as necessary.
