At any election of the commodity producers board, the\n\ncertified organization may submit to the voters a proposition to\n\nincrease the maximum rate of assessment. The referendum proposition\n\nwill be adopted upon a finding that:\n\n1. Two-thirds or more of those voting in the election voted in\n\nfavor of the referendum proposition; or\n\n2. More than one-half of those voting in the election voted in\n\nfavor of the referendum proposition, and those voting in favor of\n\nthe proposition produced at least fifty percent (50%) of the volume\n\nof the production of the commodity during the relevant production\n\nperiod.\n\nB. 1. If twenty percent (20%) or more of the producers\n\nparticipating in the program present to the certified organization a\n\npetition calling for a referendum of the qualified voters on the\n\nproposition of discontinuing the assessment, the certified\n\norganization shall conduct a referendum for that purpose. An\n\nelection on a proposition of discontinuing the assessment shall be\n\nheld no more than once per year.\n\n2. The certified organization shall give notice of the\n\nreferendum, the referendum shall be conducted, and the results shall\n\nbe declared in the manner provided by law for the original\n\nreferendum and election, with any necessary exceptions provided in\n\nbylaws of the certified organization.\n\n3. The certified organization shall conduct the referendum\n\nwithin ninety (90) days of the date of filing of the petition.\n\n4. The proposition shall be approved if:\n\na. two-thirds or more of those voting in the election\n\nvoted in favor of the referendum proposition, or\n\nb. more than one-half of those voting in the election\n\nvoted in favor of the referendum proposition, and\n\nthose voting in favor of the proposition produced at\n\nleast fifty percent (50%) of the volume of the\n\nproduction of the commodity during the relevant\n\nproduction period.\n\nC. If the proposition is approved, the assessment is abolished.\n\nD.
