A person or gleaner who, in good faith, donates food for\n\nultimate distribution without charge by a nonprofit corporation, a\n\ncharitable organization, or a state agency shall not be liable for\n\ncivil damages or criminal penalties resulting from the nature, age,\n\ncondition, or packaging of the donated food, unless an injury or\n\ndeath is caused by the gross negligence, recklessness, or\n\nintentional misconduct of the person or gleaner.\n\nB. A person who, in good faith, provides services related to\n\nthe processing of wild game that is donated to a nonprofit\n\ncorporation, a charitable organization, or a state agency for\n\nultimate distribution without charge by the nonprofit organization\n\nor the state agency shall not be liable for civil damages or\n\ncriminal penalties resulting from the nature, age, condition, or\n\npackaging of the donated food, unless an injury or death is caused\n\nby gross negligence, recklessness, or intentional misconduct of the\n\nperson.\n\nC. A nonprofit corporation or charitable organization that, in\n\ngood faith, accepts donated food for ultimate distribution without\n\ncharge shall not be liable for civil damages or criminal penalties\n\nresulting from the nature, age, condition, or packaging of the\n\ndonated food, unless an injury or death is caused by gross\n\nnegligence, recklessness, or intentional misconduct of the nonprofit\n\norganization.\n\nD.
