Stat. tit. 2, § 2-5-63.12","heading":"Federally approved commodity board - Powers and duties","body":"The federally approved commodity board shall have the power and\n\nduty to:\n\n1. Employ personnel deemed necessary by the board, fix the\n\namount and manner of their compensation, and incur other expenses\n\nthat are necessary and proper to enable the board to effectively\n\ncarry out the purposes of the Commodity Research Enhancement Act;\n\nsuch employees shall not be considered state employees for any\n\npurpose;\n\n2. Retain legal counsel as is required to fulfill the purposes\n\nof the Commodity Research Enhancement Act;\n\n3. Sue and be sued;\n\n4. Cooperate with local, state or national organizations,\n\nwhether public or private, in carrying out the purposes of contracts\n\nas may be necessary;\n\n5. Make such reasonable expenditures of funds as are necessary\n\nto carry out the provisions of the Commodity Research Enhancement\n\nAct;\n\n6. The board shall open its state assessment records to\n\nexamination by any participating producer during regular business\n\nhours; provided, the board may determine that certain information\n\nprovided by a commodity producer is proprietary and confidential;\n\n7. Set the rate of the state assessment. The rate may not\n\nexceed the maximum established in the election authorizing the state\n\nassessment or a subsequent election establishing a maximum rate;\n\n8. Act separately or in cooperation with any person in\n\ndeveloping, carrying out, and participating in programs of research,\n\ndisease and insect control, predator control, education and\n\npromotion designed to encourage the production, marketing and use of\n\nthe commodity on which the state assessment is levied; and\n\n9.
