The nonprofit commodity organization who originally\n\nsubmitted the petition for a referendum may submit to the voters a\n\nproposition to increase the maximum rate of the state assessment.\n\nThe proposition is approved, and the new maximum rate is in effect\n\nif the referendum proposition is adopted as outlined in Section 11\n\nof this act.\n\nB. 1. Consistent with the referendum process as outlined by\n\nthe federally approved commodity board, producers may petition for a\n\nreferendum to discontinue the state assessment. In the event that\n\nthe federally approved commodity board does not have an established\n\nprocess, if ten percent (10%) or more of the producers participating\n\nin the program present to the federally approved commodity board a\n\npetition calling for a referendum of the qualified voters on the\n\nproposition of discontinuing the state assessment, the nonprofit\n\ncommodity organization who originally submitted the petition for the\n\nreferendum shall conduct a referendum for that purpose. An election\n\non a proposition of discontinuing the state assessment shall be held\n\nno more than once per year.\n\n2. The nonprofit commodity organization shall give notice of\n\nthe referendum, the referendum shall be conducted, and the results\n\nshall be declared in the manner provided by law for the original\n\nreferendum.\n\n3. The nonprofit commodity organization shall conduct the\n\nreferendum within ninety (90) days of the date of filing of the\n\npetition.\n\n4. The adoption of the referendum proposition will be subject\n\nto the referendum process outlined by the federally approved\n\ncommodity board. In the event that the federally approved commodity\n\nboard does not have an outlined referendum process, the referendum\n\nproposition shall be approved if:\n\na. two-thirds (2/3) or more of those voting in the\n\nelection voted in favor of the referendum proposition,\n\nor\n\nb. more than one-half (1/2) of those voting in the\n\nelection voted in favor of the referendum proposition\n\nand those voting in favor of the proposition produced\n\nat least fifty percent (50%) of the volume of the\n\nproduction of the commodity during the relevant\n\nproduction period.\n\n5. If the proposition is approved, the state assessment is\n\nabolished.\n\nC. If the federally approved commodity board's federal\n\nassessment is increased, the state-approved assessment shall\n\nautomatically discontinue upon the date the federally approved\n\ncommodity board's new federal assessment becomes effective, unless\n\nwithin one (1) month of the announcement of the increase, the\n\nnonprofit commodity organization that originally submitted the\n\npetition for a referendum may initiate a referendum to be conducted\n\nwithin six (6) months of the announcement to determine if the state-\n\napproved assessment shall be continued.
