Any nonprofit commodity organization may petition the\n\nCommissioner of the Oklahoma Department of Agriculture, Food, and\n\nForestry to request approval to conduct a state assessment\n\nreferendum pursuant to the Commodity Research Enhancement Act.\n\n2. The petition shall state:\n\na. the name of the nonprofit organization that will\n\nconduct the referendum,\n\nb. the reasons for and the purposes of the state\n\nassessment,\n\nc. the federally approved commodity board that will be\n\ndesignated by the nonprofit commodity organization as\n\nthe recipient of the state assessment,\n\nd. the maximum state assessment to be levied pursuant to\n\nan election,\n\ne. the names and number of positions held by each\n\nnonprofit commodity organization on the federally\n\napproved commodity board, and\n\nf. such other information required by the Commissioner.\n\n3. The petition shall be signed by at least ten percent (10%)\n\nof the commodity producers in the state.\n\nB. 1. Within fifteen (15) days following the day on which a\n\npetition for certification is received, the Commissioner shall\n\nschedule a public hearing to consider the petition. The public\n\nhearing shall be scheduled no later than forty (40) days after\n\nreceipt of the completed petition by the Department.\n\n2. Upon the scheduling of the public hearing, the nonprofit\n\ncommodity organization shall provide for notification of interested\n\ncommodity producers in the manner, method and locations required by\n\nthe Oklahoma Department of Agriculture, Food, and Forestry.\n\n3. If the Commissioner determines that, on the basis of\n\ntestimony presented at the public hearing, the petitioning nonprofit\n\ncommodity organization is representative of the producers of the\n\nagricultural commodity and that the petition conforms to the\n\npurposes and provisions of the Commodity Research Enhancement Act,\n\nthe Commissioner shall designate the nonprofit commodity\n\norganization as representative of the producers of the commodity and\n\nauthorized to conduct the state assessment referendum.\n\n4.
