The State of Oklahoma is hereby declared brucellosis free.\n\nThe State Board of Agriculture may reinstitute a program of\n\nbrucellosis eradication based on the advice of the State\n\nVeterinarian and in consultation with the United States Department\n\nof Agriculture.\n\nB. Each owner of livestock shall comply with the requirements\n\nof a brucellosis plan. A licensed, accredited veterinarian or\n\nauthorized agent of the Board shall perform all tests on livestock\n\nfor brucellosis. The owner or person in control of the livestock\n\nshall render assistance in restraining the animals as the State\n\nVeterinarian or a representative of the State Veterinarian deems\n\nnecessary. Any owner or caretaker who neglects or refuses to\n\npresent the livestock for testing or refuses or neglects to assist\n\nin restraining them, upon conviction thereof, shall be guilty of a\n\nmisdemeanor.\n\nC. The State Veterinarian or representative authorized to test\n\nthe livestock may file a complaint with the district attorney who\n\nshall immediately notify the offending party either by certified\n\nmail, personal service, posting a notice on the premises, or\n\npublication that the person will have an additional ten (10) days to\n\ncomply with the requirements. If the party fails to comply, the\n\nsheriff of the county shall gather the livestock for testing. The\n\nowner shall pay all fees and costs incurred in gathering the\n\nlivestock into the county general fund, to be reappropriated to the\n\ncounty sheriff's office.\n\nD. An indemnity payment in an amount approved by the United\n\nStates Department of Agriculture and the Board shall be made on each\n\nreactor upon proof of slaughter. The Board shall pay any owner of\n\ncattle destroyed because of brucellosis an indemnity of not more\n\nthan Fifty Dollars ($50.00) for each animal, provided the animal\n\nqualifies for an indemnity payment pursuant to official state or\n\nfederal brucellosis regulations, and the state monies will be in\n\naddition to any indemnity payments by the United States Department\n\nof Agriculture. The indemnity payments shall be made from funds\n\nmade available by the United States Department of Agriculture or the\n\nBoard within the limits of availability.
