Any person who violates the provisions of Sections 6-259, 6-\n\n260, 6-261 or 6-264 of this title shall be fined not more than One\n\nThousand Dollars ($1,000.00) or imprisoned not more than one (1)\n\nyear, or both; but if such violation involves intent to defraud, or\n\nany distribution or attempted distribution of an article that is\n\nadulterated, except as defined in subparagraph (h) of paragraph 11\n\nof Section 6-254 of this title, such person shall be guilty of a\n\nClass D3 felony offense and fined not more than Ten Thousand Dollars\n\n($10,000.00), or imprisoned as provided for in subsections B through\n\nF of Section 20P of Title 21 of the Oklahoma Statutes, or both.\n\nWhen construing or enforcing the provisions of said sections, the\n\nact, omission, or failure of any person acting for or employed by\n\nany individual, partnership, corporation, or association within the\n\nscope of his employment or office shall in every case be deemed the\n\nact, omission, or failure of such individual, partnership,\n\ncorporation, or association, as well as of such person.\n\nB. No carrier shall be subject to the penalties of this act,\n\nother than the penalties for violation of Section 6-261 of this\n\ntitle, by reason of his receipt, carriage, holding, or delivery, in\n\nthe usual course of business, as a carrier of poultry or poultry\n\nproducts, owned by another person unless the carrier has knowledge,\n\nor is in possession of facts which would cause a reasonable person\n\nto believe that such poultry or poultry products were not inspected\n\nor marked in accordance with the provisions of this act or were\n\notherwise not eligible for transportation under this act or unless\n\nthe carrier refuses to furnish on request of a representative of the\n\nBoard the name and address of the person from whom he received such\n\npoultry or poultry products, and copies of all documents, if any\n\nthere be, pertaining to the delivery of the poultry or poultry\n\nproducts to such carrier.\n\nC.
