The Board shall, by regulation and under such conditions,\n\nincluding requirements, as to sanitary standards, practices, and\n\nprocedures as it may prescribe, exempt from specific provisions of\n\nthis act with respect to processing of poultry or poultry products\n\nsolely for intrastate commerce and distribution of poultry or\n\npoultry products only in such commerce:\n\n1. for such period of time as the Board determines that it\n\nwould be impracticable to provide inspection and the exemption will\n\naid in the effective administration of this act, any person engaged\n\nin the processing of poultry or poultry products and the poultry or\n\npoultry products processed by such person; provided, that, no such\n\nexemption shall continue in effect more than one hundred twenty\n\n(120) days after enactment of this act;\n\n2. persons slaughtering, processing, or otherwise handling\n\npoultry or poultry products which have been or are to be processed\n\nas required by recognized religious dietary laws, to the extent that\n\nthe Board determines necessary to avoid conflict with such\n\nrequirements while still effectuating the purposes of this act;\n\n3. the slaughtering by any person of poultry of his own\n\nraising, and the processing by him and transportation of the poultry\n\nproducts exclusively for use by him and members of his household and\n\nhis nonpaying guests and employees;\n\n4. the custom slaughter by any person of poultry delivered\n\nby the owner thereof for such slaughter, and the processing by such\n\nslaughterer and transportation of the poultry products exclusively\n\nfor use, in the household of such owner, by him and members of his\n\nhousehold and his nonpaying guests and employees; provided, that,\n\nsuch custom slaughterer does not engage in the business of buying or\n\nselling any poultry products capable of use as human food;\n\n5. operations of types traditionally and usually conducted\n\nat retail stores and restaurants, when conducted at any retail store\n\nor restaurant or similar retail-type establishment for sale in\n\nnormal retail quantities or service of such articles to consumers at\n\nsuch establishments, if no poultry or poultry products are processed\n\nat the establishment for distribution within this state or otherwise\n\nsubject to inspection under the Federal Poultry Products Inspection\n\nAct.\n\nB. The provisions of this act shall not apply to poultry\n\nproducers with respect to poultry of their own raising on their own\n\nfarms if\n\n1. such producers slaughter not more than two hundred\n\nfifty turkeys, or not more than an equivalent number of birds of all\n\nspecies during the calendar year for which this exemption is being\n\ndetermined, four birds of other species being deemed the equivalent\n\nof one turkey;\n\n2. such poultry producers do not engage in buying or\n\nselling poultry products other than those produced from poultry\n\nraised on their own farms.\n\nC. The adulteration and misbranding provisions of this act,\n\nother than the requirement of the inspection legend, shall apply to\n\narticles which are exempted from inspection under this section.\n\nD.
