Any poultry product, or any dead, dying, disabled, or\n\ndiseased poultry, that is being transported in intrastate commerce,\n\nsubject to this act, or is held for sale in this state after such\n\ntransportation, and that\n\n1. is or has been processed, sold, transported, or\n\notherwise distributed or offered or received for distribution in\n\nviolation of this act, or\n\n2. is capable of use as human food and is adulterated or\n\nmisbranded, or\n\n3. in any other way is in violation of this act, shall be\n\nliable to be proceeded against and seized and condemned, at any\n\ntime, on a libel of information in any district court within the\n\njurisdiction of which the article or poultry is found. If the\n\narticle or poultry is condemned it shall, after entry of the decree,\n\nbe disposed of by destruction or sale as the court may direct and\n\nthe proceeds, if sold, less the court costs and fees, and storage\n\nand other proper expenses, shall be paid into the treasury of this\n\nstate, but the article or poultry shall not be sold contrary to the\n\nprovisions of this act, or the Federal Poultry Products Inspection\n\nAct or the Federal Food, Drug, and Cosmetic Act; provided, that,\n\nupon the execution and delivery of a good and sufficient bond\n\nconditioned that the article or poultry shall not be sold or\n\notherwise disposed of contrary to the provisions of this act or the\n\nlaws of the United States, the court may direct that such article or\n\npoultry be delivered to the owner thereof subject to such\n\nsupervision by authorized representatives of the Board as is\n\nnecessary to insure compliance with the applicable laws. When a\n\ndecree of condemnation is entered against the article or poultry and\n\nit is released under bond, or destroyed, court costs and fees, and\n\nstorage and other proper expenses shall be awarded against the\n\nperson, if any, intervening as claimant of the article or poultry.\n\nThe proceedings in such libel cases shall conform, as nearly as may\n\nbe, to the proceedings in admiralty, except that either party may\n\ndemand trial by jury of any issue of fact joined in any case, and\n\nall such proceedings shall be at the suit of and in the name of this\n\nstate.\n\nB.
