Whenever any rabbit carcass, part of a carcass, rabbit meat\n\nor rabbit product, or any dead, dying, disabled, or diseased rabbit\n\nis found by any authorized representative of the Board upon any\n\npremises where it is held for purposes of or during or after\n\ndistribution in intrastate commerce, and there is reason to believe\n\nthat any such article is adulterated or misbranded and is capable of\n\nuse as human food, or that it has not been inspected, in violation\n\nof the provisions of the Oklahoma Rabbit and Rabbit Products\n\nInspection Act or of the Federal Meat Inspection Act or the Federal\n\nFood, Drug, and Cosmetic Act, or that such article or animal has\n\nbeen or is intended to be distributed in violation of any such\n\nprovisions, it may be detained by such representative for a period\n\nnot to exceed twenty (20) days, pending action pursuant to the\n\nOklahoma Rabbit and Rabbit Products Inspection Act or notification\n\nof any federal authorities having jurisdiction over such article or\n\nanimal, and shall not be moved by any person, firm, or corporation\n\nfrom the place at which it is located when so detained, until\n\nreleased by such representative. All official marks may be required\n\nby such representative to be removed from such article or animal\n\nbefore it is released unless it appears to the satisfaction of the\n\nBoard that the article or animal is eligible to retain such marks.\n\nB. 1. Any carcass, part of a carcass, meat or meat food\n\nproduct of rabbits, or any dead, dying, disabled, or diseased\n\nrabbits, that is being transported in intrastate commerce, or is\n\nheld for sale in this state after such transportation, and that:\n\na. is or has been prepared, sold, transported, or\n\notherwise distributed or offered or received for\n\ndistribution in violation of the Oklahoma Rabbit and\n\nRabbit Products Inspection Act,\n\nb. is capable of use as human food and is adulterated or\n\nmisbranded, or\n\nc. in any other way is in violation of the Oklahoma\n\nRabbit and Rabbit Products Inspection Act,\n\nmay be seized and condemned, at any time, on an information\n\nfiled in any proper court as provided in the Oklahoma Rabbit and\n\nRabbit Products Inspection Act within the jurisdiction of which the\n\narticle or animal is found. Any article or animal so condemned\n\nshall, after entry of the decree, be destroyed or sold for court\n\ncosts, and storage and other fees. Any storage and other fees shall\n\nbe paid into the State Treasury. The article or animal shall not be\n\nsold contrary to the provisions of the Oklahoma Rabbit and Rabbit\n\nProducts Inspection Act, or the Federal Meat Inspection Act or the\n\nFederal Food, Drug, and Cosmetic Act.\n\n2. Upon the execution and delivery of a good and sufficient\n\nbond conditioned that the article or animal shall not be sold or\n\notherwise disposed of contrary to the provisions of the Oklahoma\n\nRabbit and Rabbit Products Inspection Act, or the laws of the United\n\nStates, the court may direct that such article or animal be\n\ndelivered to the owner thereof subject to such supervision by\n\nauthorized representatives of the Board as is necessary to ensure\n\ncompliance with the applicable laws. When a decree of condemnation\n\nis entered against the article or animal and it is released under\n\nbond or destroyed, court costs and storage and other proper fees\n\nshall be awarded against the person, if any, intervening as claimant\n\nof the article or animal. The proceedings shall be at the suit of\n\nand in the name of this state.\n\nC.
