Stat. tit. 2, § 2-6-280.5","heading":"Application of act - Registration required - Prohibited","body":"acts relating to dead, dying, disabled or diseased animals -\n\nRequirements to sell rabbit products.\n\nA. The Oklahoma Rabbit and Rabbit Products Inspection Act shall\n\napply to:\n\n1. Any person that engages in the business of slaughtering any\n\nrabbits or processing, freezing, packaging, or labeling any\n\ncarcasses, or parts or products of carcasses, of any rabbit, for\n\nintrastate commerce, for use as human food or animal food. The\n\nprovisions of this paragraph shall not apply to:\n\na. the slaughtering of rabbits owned and raised by a\n\nperson who prepares and transports the carcasses of:\n\n(1) rabbits or parts of rabbits exclusively for his\n\nown use or for use by members of his household or\n\nhis nonpaying guests or employees, or\n\n(2) rabbits owned and raised by a person who prepares\n\nand transports the carcasses of uninspected\n\nrabbits or parts of rabbits exclusively for sale\n\ndirectly to household consumers. Said persons\n\nare specifically prohibited from selling or\n\ndonating uninspected rabbit products to retail\n\nstores, brokers, meat markets, schools,\n\norphanages, restaurants, nursing homes and\n\nsimilar establishments. Said persons are further\n\nprohibited from sales or donation of uninspected\n\nrabbit products to caterers, charitable\n\ninstitutions, public fund raising events and\n\nsimilar activities. Said persons are further\n\nprohibited from selling uninspected rabbit\n\nproducts through any type of retail market or\n\nsimilar establishment owned or operated by the\n\nrabbit owner or raiser,\n\nb. except as otherwise provided by this section, any\n\nperson who slaughters rabbits or processes or\n\notherwise handles rabbit products which have been or\n\nare to be processed as required by recognized\n\nreligious dietary laws.\n\n(1) Any person desiring such exemption shall make\n\napplication to the Oklahoma State Department of\n\nAgriculture. The application shall be in such\n\nform and contain such information as is required\n\nby the Board.\n\n(2) The Board may impose such conditions as to\n\nsanitary standards, practices, and procedures in\n\ngranting such exemption as it deems necessary to\n\neffectuate the purposes of the Oklahoma Rabbit\n\nand Rabbit Products Inspection Act. Any person\n\nwho processes rabbit or rabbit products under\n\nexemption from certain requirements as provided\n\nin this division shall be subject to all of the\n\nother applicable provisions of the Oklahoma\n\nRabbit and Rabbit Products Inspection Act and the\n\nregulations promulgated pursuant thereto.\n\n(3) Processing plants shall meet the sanitary\n\nrequirements set forth in the Oklahoma Rabbit and\n\nRabbit Products Inspection Act and shall be\n\nrequired to qualify for inspection and operate as\n\nofficial establishments;\n\n2. Any person who engages in the business of buying or selling,\n\nas rabbit products brokers, wholesalers, or otherwise, or\n\ntransporting, in intrastate commerce, or storing in or for\n\nintrastate commerce, any carcasses, or parts or products of\n\ncarcasses, of any rabbit; or\n\n3. Any person who engages in business, in or for intrastate\n\ncommerce, as a renderer, or engages in the business of buying,\n\nselling, or transporting, in intrastate commerce, any dead, dying,\n\ndisabled, or diseased rabbit or parts of the carcasses of any rabbit\n\nthat died otherwise than by slaughter.\n\nB. 1. Any person who is engaged in business specified in this\n\nsubsection shall be registered with the Board, in or for intrastate\n\ncommerce:\n\na. as a meat broker, renderer, or animal food\n\nmanufacturer, or engage in business in such commerce\n\nas a wholesaler of any carcasses, or parts or products\n\nof the carcasses, of any rabbits whether intended for\n\nhuman food or other purposes; or\n\nb. as a public warehouseman storing any such articles in\n\nor for such commerce, or engage in the business of\n\nbuying, selling, or transporting in such commerce any\n\ndead, dying, disabled, or diseased animals of the\nor engage in business in such commerce\n\nas a wholesaler of any carcasses, or parts or products\n\nof the carcasses, of any rabbits whether intended for\n\nhuman food or other purposes; or\n\nb. as a public warehouseman storing any such articles in\n\nor for such commerce, or engage in the business of\n\nbuying, selling, or transporting in such commerce any\n\ndead, dying, disabled, or diseased animals of the\n\nspecified kinds, or parts of the carcasses of any such\n\nanimals that died otherwise than by slaughter.\n\n2. The application for registration shall contain the name of\n\nsuch person, address of each place of business at which and all\n\ntrade names under which such person conducts such business and such\n\nother information deemed necessary by the Board.\n\nC. Any person, firm, or corporation who is engaged in the\n\nbusiness of buying, selling, or transporting in intrastate commerce\n\ndead, dying, disabled, or diseased animals, or any parts of the\n\ncarcasses of any animals that died otherwise than by slaughter,\n\nshall buy, sell, transport, offer for sale or transportation, or\n\nreceive for transportation, in such commerce, any dead, dying,\n\ndisabled, or diseased rabbits or parts of the carcasses of any such\n\nanimals that died otherwise than by slaughter, shall comply with\n\nsuch regulations as the Board prescribes to assure that such\n\nanimals, or the unwholesome parts or products thereof, will be\n\nprevented from being used for human food purposes.\n\nD. On and after September 1, 1989, no rabbit products intended\n\nfor human food shall be allowed to be sold in this state without:\n\n1. first being inspected and approved by:\n\na. the United States Department of Agriculture, or\n\nb. the Oklahoma State Department of Agriculture; or\n\n2. having been legally imported into this state pursuant to\n\nexisting laws of the federal Food, Drug and Cosmetic Act.","path":["OK Code","Title 2"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os2.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"3cabb63be0823ea599ad272352c1f30fc6d159a62a8781b8e6b0bda4f4aad201","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-2-2-6-280.4","next":"us-ok/okla.-stat.-tit.-2-2-6-280.6"},"notice":"GroundRules: Original legal text.
