Stat. tit. 2, § 2-6-290.3","heading":"Definitions","body":"For the purposes of the Exotic Livestock and Exotic Livestock\n\nProducts Inspection Act:\n\n1. \"Adulterated\" shall apply to any carcass, part thereof,\n\nexotic livestock or exotic livestock products under one or more of\n\nthe following circumstances:\n\na. if it bears or contains any poisonous or deleterious\n\nsubstance which may render it injurious to health; but\n\nin case the substance is not an added substance, such\n\narticle shall not be considered adulterated under this\n\nparagraph if the quantity of such substance in or on\n\nsuch article does not ordinarily render it injurious\n\nto health,\n\nb. if it bears or contains, by reason of administration\n\nof any substance to live exotic livestock or\n\notherwise, any added poisonous or added deleterious\n\nsubstance, other than one which is:\n\n(1) a pesticide chemical in or on a raw agricultural\n\ncommodity,\n\n(2) a food additive, or\n\n(3) a color additive;\n\nwhich may, in the judgment of the Board, make such\n\narticle unfit for human food,\n\nc. if it is, in whole or in part, a raw agricultural\n\ncommodity and such commodity bears or contains a\n\npesticide chemical which is unsafe within the meaning\n\nof Section 408 of the Federal Food, Drug, and Cosmetic\n\nAct,\n\nd. if it bears or contains any food additive which is\n\nunsafe within the meaning of Section 409 of the\n\nFederal Food, Drug, and Cosmetic Act,\n\ne. if it bears or contains any color additive which is\n\nunsafe within the meaning of Section 706 of the\n\nFederal Food, Drug, and Cosmetic Act. Provided, that\n\nan article which is not otherwise deemed adulterated\n\nunder subparagraph b, c, or d, shall nevertheless be\n\ndeemed adulterated if use of the pesticide chemical,\n\nfood additive, or color additive in or on such article\n\nis prohibited by regulations of the Board in\n\nestablishments at which inspection is maintained\n\npursuant to the Exotic Livestock and Exotic Livestock\n\nProducts Inspection Act,\n\nf. if it consists in whole or in part of any filthy,\n\nputrid, or decomposed substance or is for any other\n\nreason unsound, unhealthful, unwholesome, or otherwise\n\nunfit for human food,\n\ng. if it has been prepared, packed, or held under\n\nunsanitary conditions whereby it may become\n\ncontaminated with filth, or whereby it may have been\n\nrendered injurious to health,\n\nh. if it is, in whole or in part, the product of any\n\nexotic livestock which has died otherwise than by\n\nslaughter,\n\ni. if its container is composed, in whole or in part, of\n\nany poisonous or deleterious substance which may\n\nrender the contents injurious to health,\n\nj. if it has been intentionally subjected to radiation,\n\nunless the use of the radiation was in conformity with\n\na regulation or exemption in effect pursuant to\n\nSection 409 of the Federal Food, Drug, and Cosmetic\n\nAct, or\n\nk. if any valuable constituent has been in whole or in\n\npart omitted or abstracted therefrom; or if any\n\nsubstance has been substituted, wholly or in part\n\ntherefor; or if damage or inferiority has been\n\nconcealed in any manner; or if substance has been\n\nadded thereto or mixed or packed therewith so as to\n\nincrease its bulk or weight, or reduce its quality or\n\nstrength, or make it appear better or of greater value\n\nthan it is;\n\n2. \"Board\" means the State Board of Agriculture;\n\n3. \"Animal food manufacturer\" means any person engaged in the\n\nbusiness of manufacturing or processing animal food derived wholly\n\nor in part from carcasses, or parts or products of the carcasses, of\n\nexotic livestock;\n\n4. \"Capable of use as human food\" shall apply to any carcass,\n\nor part or product of a carcass, of any exotic livestock, unless it\n\nis identified as required by regulations prescribed by the Board to\n\ndeter its use as human food, or it is naturally inedible by humans;\n\n5. \"Department\" means the Oklahoma State Department of\n\nAgriculture;\n\n6. \"Exotic livestock\" means commercially raised livestock\nany carcass,\n\nor part or product of a carcass, of any exotic livestock, unless it\n\nis identified as required by regulations prescribed by the Board to\n\ndeter its use as human food, or it is naturally inedible by humans;\n\n5. \"Department\" means the Oklahoma State Department of\n\nAgriculture;\n\n6. \"Exotic livestock\" means commercially raised livestock\n\nincluding but not limited to animals of the families bovidae,\n\ncervidae and antilocapridae or birds of the ratite group;\n\n7. \"Federal Meat Inspection Act\" means the act so entitled\n\napproved March 4, 1907 (34 Stat. 1260) as amended by the Wholesome\n\nMeat Act (8 Stat. 584);\n\n8. \"Federal Food, Drug, and Cosmetic Act\" means the act so\n\nentitled, approved June 25, 1938 (52 Stat. 1040), and acts\n\namendatory thereof or supplementary thereto;\n\n9. \"Inspection\" or \"inspection service\" means any inspection by\n\nan inspector to determine:\n\na. the condition and wholesomeness of exotic livestock,\n\nb. the condition and wholesomeness of any edible product\n\nat any state of the preparation or packaging thereof\n\nin the official plant where inspected and certified,\n\nor\n\nc. the condition and wholesomeness of any previously\n\ninspected and certified product if such product has\n\nnot lost its identity as an inspected and certified\n\nproduct;\n\n10. \"Inspector\" means any person who is duly qualified and\n\ncertified as an agent of the Oklahoma State Department of\n\nAgriculture;\n\n11. \"Label\" means a display of written, printed, or graphic\n\nmatter upon any article or the immediate container, not including\n\npackage liners, of any article;\n\n12. \"Labeling\" means all labels and other written, printed, or\n\ngraphic matter:\n\na. upon any article or any of its containers or wrappers,\n\nor\n\nb. accompanying such article;\n\n13. \"Misbranded\" shall apply to any carcass, part thereof,\n\nexotic livestock meat or exotic livestock product under one or more\n\nof the following circumstances:\n\na. if its labeling is false or misleading in any\n\nparticular,\n\nb. if it is offered for sale under the name of another\n\nfood,\n\nc. if it is an imitation of another food, unless its\n\nlabel bears, in type of uniform size and prominence,\n\nthe word \"imitation\" and immediately thereafter the\n\nname of the food imitated,\n\nd. if its container is so made, formed, or filled as to\n\nbe misleading,\n\ne. unless it bears a label showing:\n\n(1) the name and place of business of the\n\nmanufacturer, packer, or distributor, and\n\n(2) an accurate statement of the quantity of the\n\nproduct in terms of weight, measure, or numerical\n\ncount. Provided, reasonable variations may be\n\npermitted, and exemptions as to small packages or\n\narticles not in packages or other containers may\n\nbe established, by regulations prescribed by the\n\nBoard;\n\nf. if any word, statement, or other information required\n\nby or under authority of the Exotic Livestock and\n\nExotic Livestock Products Inspection Act to appear on\n\nthe label or other labeling is not prominently placed\n\nthereon with such conspicuousness, as compared with\n\nother words, statements, designs, or devices, in the\n\nlabeling, and in such terms as to render it likely to\n\nbe read and understood by the ordinary individual\n\nunder customary conditions of purchase and use,\n\ng. if it purports to be or is represented as a food for\n\nwhich a definition and standard of identity or\n\ncomposition has been prescribed by regulations of the\n\nBoard unless:\n\n(1) it conforms to such definition and standard, and\ndevices, in the\n\nlabeling, and in such terms as to render it likely to\n\nbe read and understood by the ordinary individual\n\nunder customary conditions of purchase and use,\n\ng. if it purports to be or is represented as a food for\n\nwhich a definition and standard of identity or\n\ncomposition has been prescribed by regulations of the\n\nBoard unless:\n\n(1) it conforms to such definition and standard, and\n\n(2) its label bears the name of the food specified in\n\nthe definition and standard and, insofar as may\n\nbe required by such regulations, the common names\n\nof optional ingredients, other than spices,\n\nflavoring, and coloring, present in such food,\n\nh. if it purports to be or is represented as a food for\n\nwhich a standard or standards of fill of container\n\nhave been prescribed by regulations of the Board, and\n\nit falls below the standard of fill of container\n\napplicable thereto, unless its label bears, in such\n\nmanner and form as such regulations specify, a\n\nstatement that it falls below such standard,\n\ni. if it is not subject to the provisions of subparagraph\n\ng unless its label bears:\n\n(1) the common or usual name of the food, if any\n\nthere be, and\n\n(2) in case it is fabricated from two or more\n\ningredients, the common or usual name of each\n\nsuch ingredient; except that spices, flavorings,\n\nand colorings may, when authorized by the Board,\n\nbe designated as spices, flavorings, and\n\ncolorings without naming each. Provided, that to\n\nthe extent that compliance with the requirements\n\nof this division is impracticable, or results in\n\ndeception or unfair competition, exemptions shall\n\nbe established by regulations promulgated by the\n\nBoard,\n\nj. if it purports to be or is represented for special\n\ndietary uses, unless its label bears such information\n\nconcerning its vitamin, mineral, and other dietary\n\nproperties as the Board, after consultation with the\n\nSecretary of Agriculture of the United States,\n\ndetermines to be, and by regulations prescribes as,\n\nnecessary in order fully to inform purchasers as to\n\nits value for such uses,\n\nk. if it bears or contains any artificial flavoring,\n\nartificial coloring, or chemical preservative, unless\n\nit bears labeling stating that fact; provided, that,\n\nto the extent that compliance with the requirements of\n\nthis subparagraph is impracticable, exemptions shall\n\nbe established by regulations promulgated by the\n\nBoard, or\n\nl. if it fails to bear on its containers, as the Board\n\nmay by regulations prescribe, the official inspection\n\nlegend, such other information as the Board may\n\nrequire in such regulations to assure that it will not\n\nhave false or misleading labeling and that the public\n\nwill be informed of the manner of handling required to\n\nmaintain the article in a wholesome condition;\n\n14. \"Official certificate\" means any certificate prescribed by\n\nregulation of the Board for issuance by an inspector or other person\n\nperforming official functions pursuant to the Exotic Livestock and\n\nExotic Livestock Products Inspection Act;\n\n15. \"Official device\" means any device prescribed or authorized\n\nby the Board for use in applying any official mark;\n\n16. \"Official inspection legend\" means any symbol prescribed by\n\nregulation of the Board showing that an article was inspected for\n\nwholesomeness in accordance with the Exotic Livestock and Exotic\n\nLivestock Products Inspection Act;\n\n17. \"Official mark\" means the official inspection legend or any\n\nother symbol prescribed by regulation of the Board to identify the\n\nstatus of any article or exotic livestock pursuant to the Exotic\n\nLivestock and Exotic Livestock Products Inspection Act;\n\n18. \"Official plant\" or \"official establishment\" means one or\n\nmore buildings or parts thereof, comprising a single plant in which\n\nthe facilities and methods of operation therein have been approved\n\nby the Board as suitable and adequate for operation under inspection\n\nservice;\n\no the Exotic\n\nLivestock and Exotic Livestock Products Inspection Act;\n\n18. \"Official plant\" or \"official establishment\" means one or\n\nmore buildings or parts thereof, comprising a single plant in which\n\nthe facilities and methods of operation therein have been approved\n\nby the Board as suitable and adequate for operation under inspection\n\nservice;\n\n19. \"Person\" means any individual, partnership, corporation,\n\nassociation, or other business unit;\n\n20. \"Pesticide chemical\", \"food additive\", \"color additive\",\n\nand \"raw agricultural commodity\" shall have the same meanings for\n\npurposes of the Exotic Livestock and Exotic Livestock Products\n\nInspection Act as such term is defined by the Federal Food, Drug,\n\nand Cosmetic Act;\n\n21. \"Processed\" means slaughtered, canned, salted, stuffed,\n\nrendered, boned, cut up, or otherwise manufactured or processed;\n\n22. \"Product\" means any carcass of exotic livestock, or part\n\nthereof; or any product which is made wholly or in part from any\n\ncarcass of exotic livestock or part thereof, excepting products\n\nwhich contain exotic livestock ingredients only in a relatively\n\nsmall proportion or historically have not been considered by\n\nconsumers as products of the animal food industry, and which are\n\nexempted by the Board from definition as an exotic livestock product\n\nunder such conditions as the Board may prescribe to assure that the\n\nexotic livestock ingredients in such products are not adulterated\n\nand that such products are not represented as exotic livestock\n\nproducts;\n\n23. \"Exotic livestock broker\" means any person engaged in the\n\nbusiness of buying or selling exotic livestock products on\n\ncommission, or otherwise negotiating purchases or sales of such\n\narticles other than for his own account or as an employee of another\n\nperson;
