Stat. tit. 2, § 2-6-290.5","heading":"Application of act - Registration with Board - Dead,","body":"dying, disabled or diseased animals - Prerequisites for sale.\n\nA. The Exotic Livestock and Exotic Livestock Products\n\nInspection Act shall apply to:\n\n1. Any person that engages in the business of slaughtering any\n\nexotic livestock or processing, freezing, packaging, or labeling any\n\ncarcasses, or parts or products of carcasses, of any exotic\n\nlivestock for use as human food or animal food. The provisions of\n\nthis paragraph shall not apply to:\n\na. the slaughtering of exotic livestock owned and raised\n\nby a person who prepares and transports the carcasses\n\nof exotic livestock or parts of exotic livestock\n\nexclusively for his own use or for use by members of\n\nhis household or his nonpaying guests or employees, or\n\nb. except as otherwise provided by this section, any\n\nperson who slaughters exotic livestock or processes or\n\notherwise handles exotic livestock products which have\n\nbeen or are to be processed as required by recognized\n\nreligious dietary laws.\n\n(1) Any person desiring such exemption shall make\n\napplication to the Oklahoma State Department of\n\nAgriculture. The application shall be in such\n\nform and contain such information as is required\n\nby the Board.\n\n(2) The Board may impose such conditions as to\n\nsanitary standards, practices, and procedures in\n\ngranting such exemption as it deems necessary to\n\neffectuate the purposes of the Exotic Livestock\n\nand Exotic Livestock Products Inspection Act.\n\nAny person who processes exotic livestock or\n\nexotic livestock products under exemption from\n\ncertain requirements as provided in this division\n\nshall be subject to all of the other applicable\n\nprovisions of the Exotic Livestock and Exotic\n\nLivestock Products Inspection Act and the\n\nregulations promulgated pursuant thereto.\n\n(3) Processing plants shall meet the sanitary\n\nrequirements set forth in the Exotic Livestock\n\nand Exotic Livestock Products Inspection Act and\n\nshall be required to qualify for inspection and\n\noperate as official establishments;\n\n2. Any person who engages in the business of buying or selling,\n\nas exotic livestock products brokers, wholesalers, or otherwise, or\n\ntransporting or storing any carcasses, or parts or products of\n\ncarcasses, of any exotic livestock; or\n\n3. Any person who engages in business as a renderer, or engages\n\nin the business of buying, selling, or transporting any dead, dying,\n\ndisabled, or diseased exotic livestock or parts of the carcasses of\n\nany exotic livestock that died otherwise than by slaughter.\n\nB. 1. Any person who is engaged in business specified in this\n\nsubsection shall be registered with the Board:\n\na. as a meat broker, renderer, or animal food\n\nmanufacturer, or engage in business in such commerce\n\nas a wholesaler of any carcasses, or parts or products\n\nof the carcasses, of any exotic livestock whether\n\nintended for human food or other purposes; or\n\nb. as a public warehouseman storing any such articles in\n\nor for such commerce, or engage in the business of\n\nbuying, selling, or transporting in such commerce any\n\ndead, dying, disabled, or diseased animals of the\n\nspecified kinds, or parts of the carcasses of any such\n\nanimals that died otherwise than by slaughter.\n\n2. The application for registration shall contain the name of\n\nsuch person, address of each place of business at which and all\n\ntrade names under which such person conducts such business and such\n\nother information deemed necessary by the Board.\n\nC. Any person, firm, or corporation who is engaged in the\n\nbusiness of buying, selling, or transporting dead, dying, disabled,\n\nor diseased animals, or any parts of the carcasses of any animals\n\nthat died otherwise than by slaughter, shall buy, sell, transport,\n\noffer for sale or transportation, or receive for transportation, in\n\nsuch commerce, any dead, dying, disabled, or diseased exotic\n\nlivestock or parts of the carcasses of any such animals that died\nbusiness of buying, selling, or transporting dead, dying, disabled,\n\nor diseased animals, or any parts of the carcasses of any animals\n\nthat died otherwise than by slaughter, shall buy, sell, transport,\n\noffer for sale or transportation, or receive for transportation, in\n\nsuch commerce, any dead, dying, disabled, or diseased exotic\n\nlivestock or parts of the carcasses of any such animals that died\n\notherwise than by slaughter, shall comply with such regulations as\n\nthe Board prescribes to assure that such animals, or the unwholesome\n\nparts or products thereof, will be prevented from being used for\n\nhuman food purposes.\n\nD. On and after September 1, 1991, no exotic livestock products\n\nintended for human food shall be allowed to be sold in this state\n\nwithout:\n\n1. First being inspected and approved by:\n\na. the United States Department of Agriculture,\n\nb. the Oklahoma State Department of Agriculture, or\n\nc. a program from another state approved by the Board; or\n\n2.
