Stat. tit. 2, § 2-6-404","heading":"Court action against persons not abiding by disease","body":"control measures – Hearing – Violation.\n\nA. If the State Board of Agriculture determines that a person\n\nhas not or is not reasonably likely to abide by the disease control\n\nmeasures established by the Board, the Board may request a court\n\nhearing to determine if the emergency temporary restrictions should\n\ncontinue. The court shall schedule the hearing as expeditiously as\n\npossible. When the Board requests a court hearing under this\n\nsection, restrictions pursuant to Section 17 of this act shall\n\ncontinue to apply to the person until the court has held the\n\ntemporary emergency restrictions hearing and issues an order either\n\ncontinuing the emergency disease control measures established by the\n\nBoard or removing the emergency disease control measures.\n\nB. If the Board requests a court hearing pursuant to this\n\nsection, notice of the hearing must be served upon any person\n\nrestricted at least twenty-four (24) hours before the hearing.\n\nC. The notice must contain the following information:\n\n1. The time, date, and place of the hearing;\n\n2. The grounds and underlying facts upon which continued\n\nrestrictions are sought;\n\n3. The person's right to appear by electronic means at the\n\nhearing and the right to have a representative appear in person at\n\nthe hearing;\n\n4. The person's right to present and cross-examine witnesses;\n\nand\n\n5. The person's right to counsel, including the right, if the\n\nperson is indigent, to representation by counsel designated by the\n\ncourt or county of venue.\n\nD. 1. The court may order the continued restriction on the\n\nmovement of the person if it finds, by a preponderance of the\n\nevidence, that travel outside of the quarantine zone by the person\n\nwould pose an imminent threat of transporting a dangerous,\n\ninfectious, or communicable disease outside of the boundaries of the\n\nquarantine zone.\n\n2. If the person agrees to sign and comply with the\n\nacknowledgment form referred to in Section 17 of this act, the\n\ntemporary restrictions shall not continue longer than thirty (30)\n\ndays.\n\n3. If the person refuses to sign and comply with the\n\nacknowledgment form, the temporary restrictions shall continue for a\n\nlonger time as specified by the court.
