Stat. tit. 2, § 2-6-505","heading":"Application and licensing process, rules – Application","body":"form – Confinement of farmed cervidae - Inspections - Export of\n\ncervidae.\n\nA. The Oklahoma Department of Agriculture, Food, and Forestry\n\nshall promulgate rules regarding the application and licensing\n\nprocess, including but not limited to:\n\n1. The expiration date of a farmed cervidae facility license:\n\na. the license shall expire on June 30 of each calendar\n\nyear, and the renewal application shall be submitted\n\nno later than April 1 of each calendar year,\n\nb. any renewal application received or postmarked after\n\nthe renewal date shall be subject to a ten-percent\n\npenalty in addition to the renewal fee,\n\nc. in addition to the renewal application containing all\n\ninformation from the initial license application other\n\nthan the information requirements of paragraphs 6, 7\n\nand 8 of subsection C of Section 6-504 of this title,\n\nthe licensee shall submit a signed, complete,\n\naccurate, and legible form with the following\n\ninformation:\n\n(1) the annual report containing all inventory\n\ninformation for all cervidae one (1) year of age\n\nor older, unless the facility is a Chronic\n\nWasting Disease monitored herd with a current\n\nChronic Wasting Disease inventory on file with\n\nthe Department,\n\n(2) any changes to the facility or change in status\n\nof convictions as required by paragraph 8 of\n\nsubsection C of Section 6-504 of this title since\n\nthe last renewal or original license application,\n\nincluding, but not limited to:\n\n(a) changes in contact information, and\n\n(b) changes in perimeter fences, including\n\nattaching an updated facility map indicating\n\nany expansion, change in facility perimeter,\n\nor any additional fencing, and\n\nd. failure to renew a license by the expiration date\n\nshall result in the facility being quarantined until\n\nan administrative hearing can be conducted. The\n\nfailure may result in revocation of the license, loss\n\nof the facility number, closure of the facility, and\n\nremoval of the cervidae from the premises;\n\n2. Fees for farmed cervidae facility licenses and all renewals;\n\n3. Procedures for the transfer of ownership:\n\na. the new owner or operator shall submit to the\n\nDepartment a transfer application, attaching any\n\nchange of conditions resulting from the transfer of\n\nownership or operation,\n\nb. after receipt of the information required, the\n\nDepartment shall review the information, and within\n\nthirty (30) days, issue approval or denial of the\n\ntransfer. Transfer of a license shall be denied only\n\nif the new owner or operator cannot comply with the\n\nrequirements of transfer, and\n\nc. if a transfer is denied, written notification of the\n\ndenial and an opportunity for an administrative\n\nhearing on the denial shall be given to the applicant\n\nfor a transfer license by the Department. The\n\nnotification shall set forth the reasons for the\n\ndenial, steps necessary to meet the requirements for a\n\ntransfer license and the opportunity for the applicant\n\nto request an administrative hearing;\n\n4. Recordkeeping requirements:\n\na. all required records shall be kept by the owner or\n\noperator for a maximum of three (3) years, and\n\nb. the following records shall be maintained at the\n\nfacility:\n\n(1) records of all cervidae sold, killed, given away,\n\ntransported, or shipped from a farmed cervidae\n\nfacility,\n\n(2) proof that the cervidae are from a legal source\n\nand records kept and animals marked to identify\n\nindividual animals,\n\n(3) the Chronic Wasting Disease inventory or an\n\ninventory of cervidae one (1) year of age or\n\nolder containing the following information:\n\n(a) name and address of the farmed cervidae\n\nfacility, the owner, and the operator,\n,\n\n(2) proof that the cervidae are from a legal source\n\nand records kept and animals marked to identify\n\nindividual animals,\n\n(3) the Chronic Wasting Disease inventory or an\n\ninventory of cervidae one (1) year of age or\n\nolder containing the following information:\n\n(a) name and address of the farmed cervidae\n\nfacility, the owner, and the operator,\n\n(b) a listing of any and all identification\n\nnumbers assigned to the cervidae by the\n\nowner or operator and any other official\n\nentity using either any official\n\nidentification approved by the Department or\n\nUnited States Department of Agriculture\n\nalphanumeric test tag number or official\n\nCanadian alphanumeric test tag number, if\n\napplicable,\n\n(c) age,\n\n(d) sex,\n\n(e) date of purchase,\n\n(f) date of death or date of change of\n\nownership,\n\n(g) any cervidae born at the facility that are\n\none (1) year of age or older shall be shown\n\non the inventory record, or upon sale or\n\ntransfer of ownership or upon leaving the\n\nfacility, whichever comes first, and\n\n(h) date the inventory was completed, and\n\n(4) herd and individual animal health documents,\n\nincluding, but not limited to, the Certificate of\n\nVeterinary Inspection and test results;\n\n5. Importation requirements:\n\na. import of cervidae originating in any county or\n\nCanadian province where Chronic Wasting Disease exists\n\nin free-ranging native herds shall be prohibited,\n\nexcept the State Veterinarian may allow an import from\n\na Canadian province with Chronic Wasting Disease after\n\nnotification to the Oklahoma Department of Wildlife\n\nConservation and based on a review of the following\n\nfactors:\n\n(1) distance of the farmed cervidae facility from the\n\nChronic Wasting Disease area,\n\n(2) the existence of double fencing between the\n\nfarmed cervidae facility and free-ranging native\n\nherds,\n\n(3) farmed cervidae facility biosecurity measures,\n\n(4) participation of the farmed cervidae facility in\n\nany Canadian Chronic Wasting Disease herd\n\ncertification programs, and\n\n(5) any other relevant factors,\n\nb. all other cervidae imports shall only be from a source\n\nherd that is in a Chronic Wasting Disease surveillance\n\nand certification program for a minimum of five (5)\n\nyears monitored and the program meets the standards of\n\ncervidae importation into Oklahoma,\n\nc. import of cervidae shall be accompanied by a\n\nCertificate of Veterinary Inspection and an approved\n\nCervidae Import Permit, and\n\nd. import of cervidae shall follow all other disease\n\ntesting required by the Oklahoma Statutes or rules\n\npromulgated by the Department;\n\n6. Animal identification requirements;\n\n7. Fencing requirements and limits on the size of licensed\n\nfacilities, including:\n\na. the owner or operator shall ensure that farmed\n\ncervidae are confined to the lands described in the\n\napplication,\n\nb. the perimeter of each farmed cervidae facility shall\n\nbe an eight-foot game or high tensile fence designed\n\nin a manner to prevent ingress and egress of cervidae,\n\nc. damage caused to a farmed cervidae facility perimeter\n\nfence by a natural disaster shall not constitute a\n\nviolation so long as the owner or operator begins any\n\nnecessary repairs immediately upon discovery, acts\n\nexpeditiously in the opinion of the Department to\n\ncomplete any necessary repairs, and reports the extent\n\nand cause of any damage to the Department within two\nnd egress of cervidae,\n\nc. damage caused to a farmed cervidae facility perimeter\n\nfence by a natural disaster shall not constitute a\n\nviolation so long as the owner or operator begins any\n\nnecessary repairs immediately upon discovery, acts\n\nexpeditiously in the opinion of the Department to\n\ncomplete any necessary repairs, and reports the extent\n\nand cause of any damage to the Department within two\n\n(2) working days of discovery,\n\nd. the owner or operator shall notify the Department\n\nwithin two (2) working days of discovery of any wild\n\ncervidae within the farmed cervidae facility,\n\ne. the owner or operator shall provide each farmed\n\ncervidae with adequate water, adequate feed, and\n\nappropriate natural or manmade shelter, and\n\nf. facility size shall be limited to the largest\n\npracticable area to ensure no native or wild cervidae\n\nare within the confines of the facility. Limitations\n\non facility size may include but not be limited to\n\ngeography and topography of the property; and\n\n8. Flushing procedures prepared with the input from the\n\nDepartment of Wildlife Conservation to ensure no native cervidae\n\nremain in a newly established licensed enclosure.\n\nB. Any application for a farmed cervidae license shall be on a\n\nform prescribed by the Oklahoma Department of Agriculture, Food, and\n\nForestry.\n\nC. All farmed cervidae shall be confined to the lands described\n\nin the application for a specific facility and in a manner to\n\nprohibit:\n\n1. Native cervidae from becoming part of a licensed farmed\n\ncervidae facility; and\n\n2. Farmed cervidae from commingling with native cervidae.\n\nD. When practicable the initial or annual inspection shall be\n\ncoordinated with the owner or operator. In no case shall access by\n\nthe Department be restricted in the event coordination does not\n\noccur.\n\nE. The Department and the Department of Wildlife Conservation\n\nmay coordinate and conduct inspections or investigations jointly.\n\nF.
