Stat. tit. 2, § 2-7-405","heading":"Commissioner - Power and duty","body":"The Commissioner of Agriculture shall have the power and duty\n\nto:\n\n1. Administer and supervise the enforcement of the Oklahoma\n\nMilk and Milk Products Act;\n\n2. Provide for periodic inspection and investigation as\n\nnecessary to determine compliance with the Oklahoma Milk and Milk\n\nProducts Act and to record each inspection on a form approved by the\n\nCommissioner. Every milk producer, bulk milk hauler/sampler, milk\n\ntank truck driver, milk transportation company, milk tank truck\n\ncleaning facility, milk processor, or milk distributor engaged in\n\nproducing, transporting, processing, or distributing milk and milk\n\nproducts shall, upon request, permit access of the Commissioner to\n\nall areas of establishment, during normal business hours, to\n\nevaluate compliance with the provisions of the Oklahoma Milk and\n\nMilk Products Act;\n\n3. Secure and analyze samples of milk and milk products from\n\nany milk producer, bulk milk hauler/sampler, milk transportation\n\ncompany, milk tank truck cleaning facility, milk processor, or milk\n\ndistributor. Milk and milk products packaged for retail sale to\n\nconsumers shall not be taken without first paying or offering to pay\n\nfor the sample;\n\n4. Prohibit the producing, processing, and sale of adulterated\n\nmilk and milk products;\n\n5. Receive and investigate complaints;\n\n6. Issue permits to the owner or operator of dairy farms, bulk\n\nmilk hauler/sampler, milk tank truck driver, milk transportation\n\ncompany, milk tank truck cleaning facility, milk plants, milk\n\ndistribution centers, and receiving or transfer stations to engage\n\nin the producing, transporting, processing, or distributing of milk\n\nand milk products upon receipt of permit applications and upon\n\ndetermining that these facilities are in compliance with the\n\nOklahoma Milk and Milk Products Act and to modify, suspend, or\n\nrevoke such permits;\n\n7. Maintain laboratory reports of samples collected by the\n\nCommissioner, listings of permits issued, modified, suspended, and\n\nrevoked;\n\n8. Require submission, timely review, and approval, of plans,\n\nspecifications, and other information relative to the construction\n\nor alteration of milk and milk product facilities, prior to the\n\ncommencement of work;\n\n9. Examine statements of the actual quantities of milk and milk\n\nproducts purchased and sold, lists of all sources of milk and milk\n\nproducts, and records of cleaning, tests, and pasteurization times\n\nand temperatures of appropriate facilities; and\n\n10.
