No person shall produce, haul, process, or distribute Grade\n\nA raw milk for pasteurization or milk and milk products, or hold\n\noneself out as a milk producer, transporter, processor, or\n\ndistributor or represent a dairy farm, bulk milk hauler/sampler,\n\nmilk tank truck driver, milk transportation company, milk tank truck\n\ncleaning facility, milk plant, receiving or transfer station, milk\n\ndistribution center, or milk or milk products as \"Grade A\" unless\n\nthat person possesses an appropriate and valid permit for the\n\nparticular premises or facilities concerned.\n\nB. Applications for permits for dairy farms, bulk milk\n\nhauler/sampler, milk tank truck driver, milk transportation company,\n\nmilk tank truck cleaning facility, milk plants, receiving or\n\ntransfer stations, and milk distribution centers shall be submitted\n\non a form approved by the State Board of Agriculture. Each\n\napplicant shall allow the Commissioner to inspect the applicable\n\npremises, records, and facilities. The Board shall inspect premises\n\nand facilities and issue the permit applied for when compliance is\n\nconfirmed. The permits shall be issued without an expiration date\n\nexcept for the bulk milk hauler/sampler and milk tank truck driver\n\npermit that shall be effective for two (2) years. Permits shall not\n\nbe transferable among persons or places.\n\nC. The Board may issue permits, which shall be contingent upon\n\ncontinuing compliance, to facilities located outside this state\n\nwhich comply with the provisions of subsection B of Section 7-406 of\n\nthis title. If an out-of-state facility requests, or if the\n\nfacility is not certified, then the cost for all inspections\n\nnecessary pursuant to this subsection shall be paid by those\n\nfacilities and the amounts paid shall be deposited in the State\n\nDepartment of Agriculture Revolving Fund.\n\nD. The Board shall issue permits and establish classifications\n\nfor milk and milk products.\n\nE.
