Whenever the Commissioner of Agriculture finds any dairy\n\nproduct, in whole or in part, that fails to meet the requirements of\n\nthe Oklahoma Milk and Milk Products Act, or that a product is\n\nhandled in violation of law or rules of the State Board of\n\nAgriculture, a tag or other appropriate marking shall be affixed\n\nwhich shall give notice that the dairy product is, or is suspected\n\nof, being manufactured, produced, handled, sold, or offered for sale\n\nin violation of law or rules of the Board, and is quarantined, and\n\nwarning all persons not to remove or dispose of the dairy product\n\nuntil permission for removal or disposal is given by the\n\nCommissioner. It shall be unlawful for any person to remove or\n\ndispose of the dairy product quarantined without permission.\n\nB. If the Commissioner finds that dairy product quarantined\n\npursuant to subsection A of this section does not meet the\n\nrequirements of law, or the rules, the Commissioner may institute an\n\naction in the district court in whose jurisdiction the dairy product\n\nis quarantined, for the condemnation and destruction of the dairy\n\nproduct. If the Commissioner finds that the dairy product\n\nquarantined does meet the requirements of law and the rules, the\n\nCommissioner shall remove the quarantine. In any court proceeding\n\nregarding a quarantine, the State Department of Agriculture or the\n\nCommissioner, shall not be held liable if the court finds probable\n\ncause for the quarantine.\n\nC. If the court finds that a quarantined dairy product, in\n\nwhole or in part, is in violation of the law, the dairy product\n\nshall be destroyed at the expense of the owner or defender, under\n\nthe supervision of the Commissioner. All court costs, fees, cost of\n\nstorage, and other proper expenses shall be paid by the owner or\n\ndefender of the dairy product. The court may order that the dairy\n\nproduct be delivered to the owner or defendant for appropriate\n\nlabeling or processing under the supervision of the Commissioner if\n\nthe violation can be corrected by proper processing of the dairy\n\nproduct, all costs, fees, and expenses have been paid, and a\n\nsufficient bond is executed and conditioned for appropriate labeling\n\nor processing as the court may require.
