Stat. tit. 2, § 2-8-21","heading":"Definitions","body":"As used in this subarticle:\n\n1. \"Advertisement\" means all representations, other than those\n\non the label, disseminated in any manner or by any means relating to\n\nseed;\n\n2. \"Agricultural seeds\" means the seeds of grass, forage,\n\ncereal and fiber crops, and any other kinds of seeds commonly\n\nrecognized within this state as agricultural seeds, lawn seeds, and\n\nmixtures of seeds;\n\n3. \"Certified seed\", “registered seed\", and “foundation seed”\n\nmeans seed that has been produced and labeled in accordance with the\n\nprocedures and rules of an officially recognized seed-certifying\n\nagency or association;\n\n4. \"Coated seed\" means a seed unit covered with any substance\n\nwhich changes the size, shape, or weight of the original seed.\n\nSeeds coated with ingredients including, but not limited to,\n\nrhizobia, dyes, and pesticides are excluded;\n\n5. \"Germination\" means the percent of seeds capable of\n\nproducing normal seedlings under ordinarily favorable conditions;\n\n6. \"Kind\" means one or more related species or subspecies which\n\nsingly or collectively is known by one common name, for example,\n\ncorn, wheat, lespedeza, alfalfa, and fescue;\n\n7. \"Labeling\" means all written, printed, or graphic\n\nrepresentations accompanying and pertaining to any seed in bulk or\n\nin containers and includes, but is not limited to representations on\n\ninvoices;\n\n8. \"Lot\" means a definite quantity of seed identified by a lot\n\nnumber or other mark, every portion or bag of which is uniform\n\nwithin recognized tolerances for the factors which appear in the\n\nlabeling;\n\n9. \"Noxious weed seeds\" shall be divided into two classes,\n\n\"prohibited noxious weed seeds\" and \"restricted noxious weed seeds\"\n\nas defined in subparagraphs (a) and (b) of this paragraph. The\n\nState Board of Agriculture may promulgate rules that add to or\n\nsubtract from the list of seeds included under either definition:\n\n(a) prohibited noxious weed seeds are the seeds of weeds\n\nwhich reproduce by seeds and spread by underground\n\nroots, stems, or other reproductive parts. When\n\nestablished, noxious weed seeds are highly destructive\n\nand difficult to control in this state by ordinary\n\ngood cultural practice, and are prohibited by this\n\nsubarticle subject to recognized tolerances, and\n\n(b) restricted noxious weed seeds are the seeds of weeds\n\nwhich are very objectionable in fields, lawns, and\n\ngardens of this state, but can be controlled by good\n\ncultural practice;\n\n10. “Pure seed” means agricultural and vegetable seeds,\n\nexclusive of inert matter, and all other seeds not of the kinds, or\n\nkinds and varieties, being considered;\n\n11. \"Record\" means all information relating to lot,\n\nidentification, source, origin, variety, amount, processing,\n\ntesting, labeling, distribution, and a file sample of the seed;\n\n12. \"Seizure\" means a legal process carried out by court order\n\nor Board order against a specific quantity of seed;\n\n13. \"Stop sale\" means an administrative order provided by law\n\nrestraining the sale, use, disposition, and movement of a specific\n\nquantity of seed;\n\n14. \"Treated seed\" means seed that has been treated with an\n\napproved substance or subjected to a process designed to control or\n\nrepel plant disease organisms, insects, or other pests attacking the\n\nseed or plants or will improve the planting value of the seed;\n\n15. \"Variety\" means a subdivision of a kind characterized by\n\ngrowth, yield, plant, fruit, seed, or other characteristics by which\n\nit can be differentiated from other plants of the same kind;\n\n16. “Vegetable seeds\" means seeds of those crops which are\n\ngrown in gardens and on truck farms and are generally known and sold\n\nunder the name of vegetable seeds in this state; and\n\n17. \"Weed seeds\" means the seeds of all plants generally\n\nrecognized as undesireable within this state and includes noxious\n\nweed seeds.","path":["OK Code","Title 2"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os2.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"31f424e199c736c894c1f9d883e35caca00f109a343b979a6e4fe775a78410e6","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-2-2-793","next":"us-ok/okla.-stat.-tit.-2-2-8-22"},"notice":"GroundRules: Original legal text.
