Stat. tit. 2, § 2-8-41.3","heading":"Definitions","body":"As used in the Oklahoma Commercial Feed Law:\n\n1. \"Brand name\" means any word, name, symbol, device, or\n\ncombination identifying the commercial feed of a distributor or\n\nlicensee;\n\n2. \"Commercial feed\" means all materials except whole seeds\n\nunmixed or physically altered entire unmixed seeds, when not\n\nadulterated within the meaning of paragraph 1 of Section 8-41.7 of\n\nthis title, which are distributed for use as feed or for mixing in\n\nfeed. The term “commercial feed” shall not include:\n\na. any feed or any ingredient of feed which is to be used\n\nby a contract feeder and fed to livestock and poultry,\n\nowned solely by the manufacturer of the feed, or\n\nb. hay, straw, stover, silage, cobs, husks, hulls,\n\nindividual chemical compounds or substances or other\n\nsuch commodities when these ingredient sources are not\n\nintermixed or mixed with other materials, and are not\n\nadulterated within the meaning of Section 8-41.7 of\n\nthis title, such commodities shall also be exempt from\n\nthe provisions of this subarticle;\n\n3. \"Contract feeder\" means a person who as an independent\n\ncontractor feeds animals pursuant to a contract, the feed is\n\nsupplied, furnished, or provided to another person and the feeder's\n\nrenumeration is determined solely or in part by feed consumption,\n\nmortality, profits, or amount or quality of product;\n\n4. \"Customer-formula feed\" means commercial feed consisting of\n\na mixture of commercial feeds or feed ingredients. Each batch is\n\nmanufactured according to the specific instructions of the final\n\npurchaser;\n\n5. \"Deleterious substance\" means any substance including, but\n\nnot limited to, dust, dirt, filth, or excrement derived from\n\ninsects, birds, except domestic poultry litter, rodents, or other\n\nanimals that may render a feed material harmful or injurious when\n\nconsumed by animals;\n\n6. \"Distribute\" means to offer for sale, sell, exchange,\n\nbarter, supply, furnish, or provide commercial feed;\n\n7. \"Distributor\" means any person who distributes feed or feed\n\ningredients;\n\n8. \"Drug\" means any article intended for use in the diagnosis,\n\ncure, mitigation, treatment, or prevention of disease in animals\n\nother than humans and articles other than feed intended to affect\n\nthe structure or any function of the animal body;\n\n9. \"Feed ingredient\" means each of the constituent materials\n\nmaking up a commercial feed;\n\n10. \"Label\" means a display of written, printed, or graphic\n\nmatter upon or affixed to the container in which a commercial feed\n\nis distributed, or on the invoice or delivery slip with which a\n\ncommercial feed is distributed;\n\n11. \"Labeling\" means all labels and other written, printed, or\n\ngraphic matter upon commercial feed or any of its containers or\n\nwrappers accompanying the commercial feed;\n\n12. \"Manufacture\" means to grind, mix or blend, or further\n\nprocess a commercial feed for distribution;\n\n13. \"Mineral feed\" means a commercial feed intended to supply\n\nprimarily mineral elements or inorganic nutrients;\n\n14. \"Official sample\" means any sample of feed taken by an\n\nauthorized agent of the State Board of Agriculture;\n\n15. \"Percent\" or \"percentages\" means a portion of each hundred\n\nunits of weight;\n\n16. \"Pet\" means any domesticated animal normally maintained in\n\nor near the household of the animal's owner;\n\n17. \"Pet food\" means any commercial feed prepared and\n\ndistributed for consumption by dogs or cats;\n\n18. \"Product name\" means the name of the commercial feed which\n\nidentifies it as to kind, class, or specific use;\n\n19. \"Specialty pet\" means any domesticated animal pet normally\n\nmaintained in a cage or tank, including, but not limited to,\n\ngerbils, hamsters, canaries, psittacine birds, mynahs, finches,\n\ntropical fish, goldfish, snakes, and turtles;\n\n20. \"Specialty pet food\" means any commercial feed prepared and\n\ndistributed for consumption by specialty pets; and\ntifies it as to kind, class, or specific use;\n\n19. \"Specialty pet\" means any domesticated animal pet normally\n\nmaintained in a cage or tank, including, but not limited to,\n\ngerbils, hamsters, canaries, psittacine birds, mynahs, finches,\n\ntropical fish, goldfish, snakes, and turtles;\n\n20. \"Specialty pet food\" means any commercial feed prepared and\n\ndistributed for consumption by specialty pets; and\n\n21. \"Ton\" means a net weight of two thousand (2,000) pounds\n\navoirdupois.","path":["OK Code","Title 2"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os2.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"4f995aef09f90b0ca24ac5df6c66731e250dcb0fe3ca151a9de5cae05773cfc2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-2-2-8-41.2","next":"us-ok/okla.-stat.-tit.-2-2-8-41.4"},"notice":"GroundRules: Original legal text.
