Stat. tit. 2, § 2-8-41.7","heading":"Adulteration","body":"A commercial feed shall be adulterated if:\n\n1. a. it contains any poisonous or deleterious substance\n\nwhich may render it injurious to health. If the\n\nsubstance is not an added substance, the commercial\n\nfeed shall not be considered adulterated under this\n\nsubsection if the quantity of the substance in the\n\ncommercial feed does not ordinarily render it\n\ninjurious to health when utilized according to label\n\nand/or labeling directions, or\n\nb. it contains any added poisonous, added deleterious, or\n\nadded nonnutritive substance which is unsafe within\n\nthe meaning of Section 406 of the Federal Food, Drug,\n\nand Cosmetic Act other than one which is:\n\n(1) a pesticide chemical in or on a raw agricultural\n\ncommodity; or\n\n(2) a food additive, or\n\nc. it is, or contains, any food additive which is unsafe\n\nwithin the meaning of Section 409 of the Federal Food,\n\nDrug, and Cosmetic Act, or\n\nd. it is a raw agricultural commodity and it bears or\n\ncontains a pesticide chemical which is unsafe within\n\nthe meaning of Section 408(a) of the Federal Food,\n\nDrug, and Cosmetic Act. Provided, that where a\n\npesticide chemical has been used in or on a raw\n\nagricultural commodity pursuant to an exemption or a\n\ntolerance under Section 408 of the Federal Food, Drug,\n\nand Cosmetic Act and the raw agricultural commodity has\n\nbeen subjected to processing similar to canning,\n\ncooking, freezing, dehydrating, or milling, the residue\n\nof the pesticide chemical remaining in or on the\n\nprocessed feed shall not be deemed unsafe if:\n\n(1) the residue has been removed to the extent\n\npossible in good manufacturing practice, and\n\n(2) the concentration of the residue in the processed\n\nfeed is not greater than the tolerance prescribed for\n\nthe raw agricultural commodity unless the feeding of\n\nthe processed feed will result or is likely to result\n\nin a pesticide residue in the edible product of the\n\nanimal, which is unsafe within the meaning of Section\n\n408(a) of the Federal Food, Drug, and Cosmetic Act, or\n\ne. it is or contains any color additive which is unsafe\n\nwithin the meaning of Section 706 of the Federal Food,\n\nDrug, and Cosmetic Act;\n\n2. Any valuable constituent has been in whole or in part\n\nomitted or abstracted or any less valuable substance substituted;\n\n3. Its composition or quality falls below or differs from that\n\nwhich it is purported or is represented to possess by its labeling;\n\n4. It contains a drug and the methods used in or the facilities\n\nor controls used for its manufacture, processing, or packaging do\n\nnot conform to current good manufacturing practice rules promulgated\n\nby the State Board of Agriculture to assure that the drug meets the\n\nrequirement of this subarticle as to safety and has the identity and\n\nstrength and meets the quality and purity characteristics which it\n\npurports or is represented to possess. In promulgating the rules,\n\nthe Board shall adopt the current good manufacturing practice\n\nregulations for medicated feed premixes and for medicated feeds\n\nestablished under authority of the Federal Food, Drug, and Cosmetic\n\nAct, unless the Board determines that they are not appropriate to\n\nthe conditions which exist in this state; or\n\n5.
