An inspection fee at the rate of fifteen cents ($0.15) per\n\nton shall be paid on commercial feeds and/or feed ingredients\n\ndistributed in this state by the person whose name appears on the\n\nlabel as the manufacturer, guarantor, or distributor, except that a\n\nperson other than the manufacturer, guarantor, or distributor may\n\nassume liability for the inspection fee, subject to the following:\n\n1. No fee shall be paid on a commercial feed if the payment has\n\nbeen made by a previous distributor;\n\n2. The minimum inspection fee shall be Ten Dollars ($10.00)\n\nsemi-annually;\n\n3. No fee shall be paid on commercial feeds or feed ingredients\n\nused in customer-formula feeds if the inspection fee has been\n\npreviously paid on those ingredients; and\n\n4. No fee shall be paid on customer-formula feed ingredients\n\nthat have been furnished by the final purchaser on which a\n\nprocessing fee has been paid.\n\nB. Each person who is liable for the payment of the fee shall:\n\n1. File, not later than the last day of January and July of\n\neach year, a semi-annual statement listing the number of net tons of\n\ncommercial feeds distributed in this state during the preceding\n\nsemi-annual period; and upon filing the statement shall pay the\n\ninspection fee at the rate stated in subsection A of this section.\n\nInspection fees which are due and have not been remitted to the\n\nState Board of Agriculture within fifteen (15) days following the\n\ndate due shall have a penalty fee of ten percent (10%) (Fifty\n\nDollars ($50.00) minimum) added to the amount due when payment is\n\nfinally made. The assessment of this penalty fee shall not prevent\n\nthe Board from taking other actions as provided in this act; and\n\n2. Keep records required by the Board to indicate accurately\n\nthe tonnage of commercial feed distributed in this state, and the\n\nBoard shall have the right to examine these records to verify\n\nstatements of tonnage. Failure to make an accurate statement of\n\ntonnage, failure to pay the inspection fee, or falsifying\n\ninformation or failure to comply shall constitute sufficient cause\n\nfor the cancellation of the commercial feed license.\n\nC. Fees collected shall be deposited with the State Department\n\nof Agriculture Revolving Fund.\n\nD. If the Board finds any deficient inspection fees due, as a\n\nresult of an audit of the records of any person subject to the\n\nprovisions of the Oklahoma Commercial Feed Law, the Board shall\n\nassess a penalty fee of ten percent (10%) maximum not to exceed Two\n\nThousand Dollars ($2,000.00) of amount due, or One Hundred Dollars\n\n($100.00), whichever is greater.
