Sections 8-77.1 through 8-77.18 of this subarticle shall be\n\nknown and may be cited as the \"Oklahoma Fertilizer Act\".\n\nB. The purpose of the Oklahoma Fertilizer Act is to provide\n\nassurances to the consumer that fertilizer products are properly\n\nidentified, and that the quality represented by the manufacturer is\n\naccurate as well as for regulation of the storage, use, and\n\napplication of fertilizer to protect the consumer and the\n\nenvironment.\n\nC. The Legislature hereby occupies and preempts the entire\n\nfield of legislation in this state touching in any way the\n\nregulation and enforcement of the registration, labeling, sale,\n\nstorage, transportation, distribution, notification of use, and\n\nagricultural use of fertilizer to the complete exclusion of any\n\norder, ordinance or regulation by any municipality or other\n\npolitical subdivision of this state.\n\nD. No political subdivision shall regulate the registration,\n\npackaging, labeling, sale, storage, distribution, agricultural use\n\nor application of fertilizer. No political subdivision shall adopt\n\nor continue in effect local orders, ordinances, or regulations in\n\nthis field, except for those relating to nonagricultural use or\n\napplication or taxation relating to registration, packaging,\n\nlabeling, sale, storage, distribution, use or application of\n\nfertilizers.
