A payment of two (2) times the value of the deficiency or\n\ndeficiencies shall be assessed:\n\n1. If the analysis shows that a fertilizer is deficient in one\n\nof its guaranteed primary plant nutrients beyond the investigational\n\nallowances and compensations as established by rules; or\n\n2. If the overall commercial value of the fertilizer is below\n\nthe level established by rule, a penalty payment of two (2) times\n\nthe value of the deficiency or deficiencies shall be assessed.\n\nB. When a fertilizer is subject to a penalty payment under\n\nsubsection A of this section, the larger penalty payment shall\n\napply.\n\nC. All penalty payments assessed under this subsection A of\n\nthis section shall be paid by the registrant or licensee to the\n\nconsumer of the lot of fertilizer represented by the sample analyzed\n\nwithin thirty (30) days after the date of notice. Copies of\n\nconsumer refund receipts shall be forwarded to the State Board of\n\nAgriculture. If a consumer cannot be found, the penalty shall be\n\npaid and deposited in the State Department of Agriculture Revolving\n\nFund.\n\nD.
