Stat. tit. 2, § 2-8-77.15","heading":"Storage, use and application - Environmental","body":"jurisdiction.\n\nA. No person owning or operating a fertilizer storage facility\n\nor a commercial fertilizer facility shall discharge or release or\n\nplace or cause to be placed any fertilizer material in a location\n\nwhere it is likely to cause contamination of any surface water or\n\ngroundwater of this state. The provisions of this subsection shall\n\nnot prohibit or restrict the land application of fertilizer for\n\nagriculture purposes or plant growth.\n\nB. Preventive measures designed to minimize the possibility of\n\nfertilizer substances being introduced into waters of the state\n\nshall be subject to State Board of Agriculture jurisdiction\n\nincluding regulatory response.\n\nC. 1. The Department of Environmental Quality shall have\n\nenvironmental jurisdiction over:\n\na. commercial manufacturers of fertilizers, grain and\n\nfeed products, and chemicals, and over manufacturing\n\nof food and kindred products, tobacco, paper, lumber,\n\nwood, textile mill and other agricultural products,\n\nb. slaughterhouses, but not including feedlots at these\n\nfacilities, and\n\nc. aquaculture and fish hatcheries,\n\nincluding, but not limited to, discharges of pollutants and storm\n\nwater to waters of the state, surface impoundments and land\n\napplication of wastes and sludge, and other pollution originating at\n\nthese facilities.\n\n2. Facilities which store grain, feed, seed, fertilizer, and\n\nagricultural chemicals that are required by federal National\n\nPollutant Discharge Elimination System (NPDES) regulations to obtain\n\na permit for storm water discharges shall only be subject to the\n\njurisdiction of the Department of Environmental Quality with respect\n\nto such storm water discharges.\n\nD. Bulk fertilizers shall be stored in a manner that minimizes\n\nthe release of fertilizers and protects the environment.
