Stat. tit. 2, § 2-8-77.3","heading":"Definitions","body":"As used in the Oklahoma Fertilizer Act:\n\n1. \"Brand\" means a term, design, or trademark used in\n\nconnection with one or several grades of fertilizer;\n\n2. \"Broker\" means a person who negotiates sales and purchases\n\nbetween a manufacturer, distributor, final consumer, or retailer of\n\nfertilizer;\n\n3. \"Bulk fertilizer\" means fertilizer distributed in a\n\nnonpackaged form;\n\n4. \"Commercial fertilizer\" means fertilizer sold in bulk\n\nquantities or packages greater than thirty (30) pounds;\n\n5. \"Custom blend\" means fertilizer formulated according to\n\nspecifications furnished by the final consumer;\n\n6. \"Custom blender\" means a person who mixes or commingles\n\nfertilizer into a custom blend and who distributes the special\n\nblend. A custom blender shall not be required to register each\n\ngrade of fertilizer in the following circumstances:\n\na. the custom blend is formulated according to\n\nspecifications furnished by the ultimate consumer\n\nprior to mixing, and\n\nb. the custom blend is prepared by a lawn care or tree\n\nservice company that mixes or commingles fertilizer\n\nand who applies the special blend for the ultimate\n\nconsumer;\n\n7. \"Deficiency\" means the amount of nutrient found by analysis\n\nless than that guaranteed, which may result from a lack of nutrient\n\ningredients or from lack of uniformity;\n\n8. \"Distribute\" means to import, consign, manufacture, blend,\n\noffer for sale, sell, barter, commercially apply, or supply\n\nfertilizer in this state including, but not limited to, the delivery\n\nof bagged, labeled and registered fertilizer to a nonregistrant that\n\nsells the fertilizer in this state;\n\n9. \"Distributor\" means any person who distributes fertilizer;\n\n10. \"Fertilizer\" means any substance containing one or more\n\nrecognized plant nutrients which are used for its plant nutrient\n\ncontent and is designed for use or claimed to have value in\n\npromoting plant growth, except unmanipulated animal and vegetable\n\nmanures, marl, lime, limestone, and wood ashes;\n\n11. \"Fertilizer dealer\" means any person operating a business\n\nthat is engaged in the distribution or sale of fertilizer. The term\n\n\"fertilizer dealer\" shall not include an ultimate consumer who is\n\nengaged in the physical act of application of fertilizer or a retail\n\nstore selling only bagged registered commercial fertilizer other\n\nthan bagged ammonium nitrate;\n\n12. \"Grade\" means the percentage of total nitrogen, available\n\nphosphate, and soluble potash stated in whole numbers. Specialty\n\nfertilizer may be guaranteed in fractional units of less than one\n\npercent (1%) of total nitrogen, available phosphate, and soluble\n\npotash. Fertilizer materials, bone meal, manures, and similar\n\nmaterials may be guaranteed in fractional units;\n\n13. \"Guaranteed analysis\" means the minimum percentage of plant\n\nnutrients claimed in the following order and form:\n\nTotal Nitrogen (N) ________%\n\nAvailable Phosphate (P2O5) ________%\n\nSoluble Potash (K2O) ________%.\n\nWhen any plant nutrients, substances, or compounds are guaranteed,\n\nthey shall be subject to inspection and analysis;\n\n14. \"Guarantor\" means the person responsible to the State Board\n\nof Agriculture for any claims or guarantees associated with the\n\nmanufacture, distribution, and use of a fertilizer;\n\n15. \"Investigational allowance\" means an allowance for\n\nvariations inherent in the taking, preparation, and analysis of an\n\nofficial sample of fertilizer;\n\n16. \"Label\" means the display of all written, printed, or\n\ngraphic matter, upon the immediate container, or a statement\n\naccompanying fertilizer;\n\n17. \"Labeling\" means all written, printed, or graphic matter,\n\nupon or accompanying any fertilizer, or advertisements, brochures,\n\nposters, or television and radio announcements used in promoting the\n\nsale of fertilizer;\n\n18. \"Licensee\" means the person receiving a license to\n\ndistribute fertilizer under the provisions of the Oklahoma\n\nFertilizer Act;\nner, or a statement\n\naccompanying fertilizer;\n\n17. \"Labeling\" means all written, printed, or graphic matter,\n\nupon or accompanying any fertilizer, or advertisements, brochures,\n\nposters, or television and radio announcements used in promoting the\n\nsale of fertilizer;\n\n18. \"Licensee\" means the person receiving a license to\n\ndistribute fertilizer under the provisions of the Oklahoma\n\nFertilizer Act;\n\n19. \"Manipulated manures\" means substances composed primarily\n\nof animal excreta, plant remains, or mixtures of these substances\n\nwhich have been processed by natural or mechanical drying or\n\ncomposting and no other chemicals have been added;\n\n20. \"Mixed fertilizer\" means a fertilizer containing any\n\ncombination or mixture of fertilizer materials;\n\n21. \"Official sample\" means any sample of fertilizer taken by\n\nan authorized agent of the Board;\n\n22. \"Percent\" or \"percentage\" means the portion of each hundred\n\nunits of weight;\n\n23. \"Primary nutrient\" means total nitrogen, available\n\nphosphate, and soluble potash;\n\n24. \"Registrant\" means the person registering fertilizer under\n\nthe provisions of the Oklahoma Fertilizer Act;\n\n25. \"Specialty fertilizer\" means fertilizer sold in packages of\n\nless than thirty (30) pounds;\n\n26. \"Ton\" means a net weight of two thousand (2,000) pounds\n\navoirdupois;\n\n27. \"Ultimate consumer\" means a person who receives fertilizer\n\nfor personal use.
