Stat. tit. 2, § 2-8-85.3","heading":"Definitions","body":"As used in the Soil Amendment Act:\n\n1. “Active ingredient” or “soil amending ingredient” means:\n\na. the ingredient or ingredients that affect the\n\nphysical, chemical, or other characteristics of the\n\nsoil and improve soil condition, or\n\nb. any natural or synthetic substance when applied to\n\nplants or seeds that is intended to improve crop\n\nproduction, germination, growth, yield, product\n\nquality, reproduction, flavor or other desirable\n\ncharacteristics of plants;\n\n2. “Adulterated” means and shall apply to any soil amendment\n\nif:\n\na. it contains any deleterious or harmful agent in\n\nsufficient amount to render it injurious to beneficial\n\nplants, animals, or aquatic life when applied in\n\naccordance with the directions for use shown on the\n\nlabel; or if adequate warning statements and\n\ndirections for use, necessary to protect plants,\n\nanimals, or aquatic life are not shown on the label,\n\nb. its composition falls below purported labeling\n\nrequirements, or\n\nc. it contains noxious weed seed;\n\n3. “Bulk” means in nonpackaged form;\n\n4. “Distribute” means to import, consign, manufacture, blend,\n\noffer for sale, sell, barter, or to supply soil amendments to any\n\nperson in this state;\n\n5. “Distributor” means any person who imports, consigns,\n\nmanufactures, blends, sells, offers for sale, barters or supplies\n\nsoil amendments in this state;\n\n6. “Inert ingredient” or “other ingredient” means the\n\ningredients with no beneficial effect that are present in the\n\nproduct;\n\n7. “Label” means the display of written, printed, or graphic\n\nmatter upon the immediate container of a soil amendment;\n\n8. “Labeling” means all written, printed, or graphic matter\n\nupon or accompanying any soil amendment, and all advertisements,\n\nbrochures, posters, television, or radio announcements used in\n\npromoting the sale of a soil amendment;\n\n9. “Manufacturer” means any person who produces, compounds,\n\nmixes, or blends soil amendments;\n\n10. “Misbranded” means and shall apply if:\n\na. any soil amendment bears a label that is false or\n\nmisleading in any particular,\n\nb. any soil amendment is distributed under the name of\n\nanother soil amendment,\n\nc. any material is represented as a soil amendment or is\n\nrepresented as containing a soil amendment, unless the\n\nsoil amendment conforms to the definition of identity,\n\nif any, prescribed by rules,\n\nd. the active ingredient in any soil amendment is not\n\nshown in the approved ingredient form, or\n\ne. the labeling on any soil amendment is false or\n\nmisleading in any particular;\n\n11. “Name” means the specific designation under which the\n\nindividual product is offered for sale;\n\n12. “Percent” or “percentage” means the portion of each one\n\nhundred (100) units of weight;\n\n13. “Registrant” means any person who registers a soil\n\namendment under the provisions of the Soil Amendment Act; and\n\n14. “Soil amendment” means any substance which is intended to\n\nimprove the physical, chemical, or other characteristics of the\n\nsoil, horticultural growing media, or any natural or synthetic\n\nsubstance applied to plants or seeds that is intended to improve\n\ncrop production, germination, growth, yield, product quality,\n\nreproduction, flavor or other desirable characteristics of plants\n\nexcept the following: commercial fertilizers, agricultural liming\n\nmaterials, agricultural gypsum, unmanipulated animal manures,\n\nunmanipulated vegetable manures, and pesticides; provided that\n\ncommercial fertilizer shall be included if it is represented to\n\ncontain, as an active ingredient, a substance other than a\n\nrecognized plant food element or is represented as promoting plant\n\ngrowth by other than supplying a recognized plant food element.","path":["OK Code","Title 2"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os2.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"983a4a28fa7129c3619397b512147116772befc88a15dfca2b730db90c617c2f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-2-2-8-85.2","next":"us-ok/okla.-stat.-tit.-2-2-8-85.4"},"notice":"GroundRules: Original legal text.
