Effective October 1, 2004, any surviving spouse of a\n\ndeceased Justice or judge shall be eligible to receive an additional\n\nmonthly survivor benefit provided:\n\n1. The Justice or judge retired or died on or after July 1,\n\n1999;\n\n2. The Justice or judge paid the required contributions to\n\nprovide the survivor benefits as set forth in Section 1103 of this\n\ntitle prior to July 1, 1999;\n\n3. Those required additional contributions have not been\n\nrefunded to the Justice or judge or to a beneficiary;\n\n4. The Justice or judge and the surviving spouse remained\n\ncontinuously married; and\n\n5. The Justice or judge continued to make such required\n\ncontributions to provide the survivor benefits up to the time of\n\nretirement or death.\n\nThe additional amounts described in subsection B of this section\n\nshall not be made to the surviving spouse if the member elects an\n\nOption A or Option B survivor option pursuant to Section 3 of this\n\nact.\n\nB. Any eligible surviving spouse of a deceased Justice or\n\njudge, as described in subsection A of this section, shall receive\n\nan additional monthly survivor benefit, based upon the length of\n\npayments of the required contributions to provide the survivor\n\nbenefits as set forth in Section 1103 of this title which were made\n\nprior to July 1, 1999, as follows:\n\nLength of Payments Survivor Benefit % Increase\n\n1 month - 9 years, 11 months 5%\n\n10 years - 19 years, 11 months 10%\n\n20 years or more 15%\n\nC. The survivor benefit increase shall be in addition to the\n\nfifty percent (50%) survivor benefit otherwise payable pursuant to\n\nSection 1102A of this title. An eligible surviving spouse of a\n\ndeceased Justice or judge who, on September 30, 2004, is receiving\n\nbenefits from the Uniform Retirement System for Justices and Judges\n\nshall be entitled to receive the survivor benefit increase set forth\n\nabove beginning with the October 1, 2004, monthly benefit payment.\n\nAn eligible surviving spouse of a deceased Justice or judge who\n\nbegins receiving benefits from the Uniform Retirement System for\n\nJustices and Judges after September 30, 2004, shall be entitled to\n\nreceive the survivor benefit increase set forth above beginning with\n\nthe first month of survivor benefit payments.","path":["OK Code","Title 20"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os20.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"4d8bb64011fa52c38d3a812f21b41b588342705ff270735979b77aa6ca3bf3c2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-20-20-1103.3","next":"us-ok/okla.-stat.-tit.-20-20-1103c"},"notice":"GroundRules: Original legal text.
