Stat. tit. 20, § 20-1104","heading":"Retirement compensation","body":"Each justice or judge who is a member of The Uniform Retirement\n\nSystem for Justices and Judges upon retirement after June 30, 2004,\n\nshall be entitled to receive as retirement compensation, until\n\nchanged by the Legislature, an annual amount, each monthly payment\n\nof which shall be in an amount equal to four percent (4%) of the\n\naverage monthly salary received by him or her as a justice or judge\n\nbased on the highest three (3) years of active service multiplied by\n\nthe number of total years of service and reduced according to the\n\nelected survivor option, if any. The amounts of compensation\n\nreported to the Oklahoma Public Employees Retirement System for the\n\nUniform Retirement System for Justices and Judges, by the Office of\n\nManagement and Enterprise Services prior to June 30, 2004, may be\n\nconclusively presumed as valid regarding the source of the\n\ncompensation reported as salary for purposes of the accuracy of the\n\nemployees' contributions and the computation of salary for the\n\ncalculation of benefits. This presumption shall not include any\n\ncomputation error made by the Office of Management and Enterprise\n\nServices or the Oklahoma Public Employees Retirement System on\n\nbehalf of the Uniform Retirement System for Justices and Judges.\n\nProvided, however, that no justice or judge retiring after June 30,\n\n2004, may receive a monthly retirement benefit in excess of one\n\nhundred percent (100%) of the average monthly salary based on the\n\nhighest three (3) years of active service and found applicable to\n\nsuch justice or judge at the time of retirement.
