Stat. tit. 20, § 20-1313.7","heading":"Medical expense liability fee - Remission of fees to","body":"Medical Expense Liability Revolving Fund - Criteria for use of\n\nmonies.\n\nA. In addition to the fees imposed by Sections 1313.2 and\n\n1313.3 of this title, any person convicted of any offense, excluding\n\nmunicipal ordinances, traffic offenses and parking and standing\n\nviolations, but including violations of Section 11-902 of Title 47\n\nof the Oklahoma Statutes, punishable by a fine of Ten Dollars\n\n($10.00) or more or by incarceration or any person forfeiting bond\n\nwhen charged with such offense, shall be ordered by the court to pay\n\na medical expense liability fee in the amount of Ten Dollars\n\n($10.00) for each offense to the Medical Expense Liability Revolving\n\nFund provided for in Section 746.1 of Title 19 of the Oklahoma\n\nStatutes. The fee shall be in addition to and not in substitution\n\nfor any and all fines and penalties otherwise provided for by law\n\nfor such offense.\n\nB. The county court clerk shall cause to be deposited the\n\namount of Ten Dollars ($10.00) as collected, for every conviction as\n\ndescribed in this subsection. The county court clerk shall remit\n\nthe monies in the fund on a monthly basis to the Medical Expense\n\nLiability Revolving Fund.\n\nThe monies from the Medical Expense Liability Revolving Fund\n\nshall be used when all of the following criteria are met:\n\n1. The county has not filed a claim against the fund in the\n\nprevious twelve (12) months;\n\n2. A county jail in this state is determined to be liable for\n\nthe medical expense or expenses of a state inmate or person in\n\ncustody on state charges as provided by law. The minimum expense\n\namount that shall qualify for consideration is Six Thousand Dollars\n\n($6,000.00) per ailment or injury;\n\n3. The county clerk of the county makes a written claim to the\n\nState and Education Employees Group Insurance Board regarding a\n\ncounty medical expense. In addition to the written claim, all of\n\nthe medical records and bills shall be submitted that relate to the\n\nmedical expense under consideration; and\n\n4. It is determined that the state inmate or person in custody\n\non state charges lacks the ability and resources to cover the\n\nmedical expense or expenses.\n\nC. The Medical Expense Liability Revolving Fund shall not pay\n\nany expenses in excess of One Hundred Thousand Dollars ($100,000.00)\n\nper state inmate or person in custody on state charges. The State\n\nand Education Employees Group Insurance Board shall pay valid\n\nrequests for reimbursements quarterly based upon a pro rata share of\n\navailable funds being distributed between all valid claims received\n\nwithin the preceding quarter. In the event there are insufficient\n\nfunds available to pay any outstanding requests, the Board shall pay\n\nsuch requests only after sufficient funds have accumulated. Nothing\n\nin this subsection shall be construed to require payment in full of\n\nany or all valid claims or the holding of any or all valid claims\n\nuntil sufficient funds have accumulated to pay the claims in full.\n\nD. If the state inmate or person in custody on state charges\n\nreceives any type of compensation or award from a collateral source\n\nas a result of the ailment or injury which is paid by the Medical\n\nExpense Liability Revolving Fund, the state shall be subrogated to\n\nthe rights of a claimant to receive or recover from a collateral\n\nsource to the extent that medical expenses were awarded.","path":["OK Code","Title 20"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os20.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d0be81df72034237252f4bcedff3623b9a7005ce7c7ee6b3501998d5779a0779","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-20-20-1313.6","next":"us-ok/okla.-stat.-tit.-20-20-1314"},"notice":"GroundRules: Original legal text.
