No Justice of the Supreme Court of this state or Judge of\n\nthe Criminal Court of Appeals shall participate in the decision of\n\nany appellate cause in which the Justice or Judge presided at the\n\ntrial of such cause.\n\nB. When a Justice of the Supreme Court is recused or\n\ndisqualified from deciding a cause for any reason, the remainder of\n\nthe Court shall decide the cause. If, during the decision of any\n\ncause, there are less than seven (7) qualified Justices, the Clerk\n\nof the Court shall certify all such recusals or disqualifications to\n\nthe Governor who shall assign a retired Supreme Court Justice to the\n\nmatter in substitution of the recused or disqualified Justices. If\n\nno retired Supreme Court Justice is able to serve, the Governor\n\nshall assign a member of the Bar of this state who possesses the\n\nsame qualifications as the members of the Supreme Court to the\n\nmatter in substitution of the recused or disqualified Justice.\n\nC. When a Judge of the Court of Criminal Appeals is recused or\n\ndisqualified from deciding a cause for any reason, the Clerk of the\n\nCourt shall certify the recusal or disqualification along with the\n\ncase number to the Governor who shall assign a retired Judge of the\n\nCourt of Criminal Appeals to the matter in substitution of the\n\nrecused or disqualified Judge. If no retired Judge of the Court of\n\nCriminal Appeals is able to serve, the Governor shall assign a Judge\n\nof the Court of Civil Appeals to the matter in substitution of the\n\nrecused or disqualified Judge. If no Judge of the Court of Civil\n\nAppeals is able to serve, the Governor shall assign a member of the\n\nBar of this state who possesses the same qualifications as the\n\nmembers of the Court of Criminal Appeals to the matter in\n\nsubstitution of the recused or disqualified Judge.\n\nR.L. 1910, § 5815.
