The Supreme Court or the Court of Criminal\n\nAppeals of this state, on the motion of a party to pending\n\nlitigation or on its own motion, may certify a question of law to\n\nthe highest court of another state, or of a federally recognized\n\nIndian tribal government, or of Canada, a Canadian province or\n\nterritory, Mexico, or a Mexican state if:\n\n1. The pending litigation involves a question to be decided\n\nunder the law of the other jurisdiction;\n\n2. The answer to the question may be determinative of an issue\n\nin the pending litigation; and\n\n3.
