Stat. tit. 20, § 20-60.3","heading":"Declaration of emergency - Activation of emergency panels","body":"- Assignment and disposition of cases - Number of panels - Minimum\n\nnumber of unassigned regular felony appeals.\n\nA. An emergency appellate panel of the Emergency Appellate\n\nDivision may be activated upon request of the Presiding Judge of the\n\nCourt of Criminal Appeals when the Chief Justice of the Supreme\n\nCourt declares an emergency to exist. For purposes of this section,\n\n\"emergency\" means any situation in which there are pending in the\n\noffice of the Clerk of the Court of Criminal Appeals more than one\n\nhundred (100) regular felony appeals at issue. For purposes of this\n\nsection, \"at issue\" means a case in which responses from both the\n\nappellant/petitioner and appellee/respondent (if such response is\n\nnecessary) have been filed with the Clerk.\n\nB. In the event an emergency is declared, the Presiding Judge\n\nof the Court of Criminal Appeals shall appoint emergency appellate\n\npanels of three (3) judges each from the judges chosen by the Chief\n\nJustice of the Supreme Court, select a Presiding Judge, and assign\n\nto each emergency appellate panel such cases as the Court of\n\nCriminal Appeals deems necessary. At least two judges from each\n\nemergency appellate panel must concur in any decision. The Court of\n\nCriminal Appeals may prescribe by rule where each emergency\n\nappellate panel shall sit and how each panel shall conduct its\n\nbusiness and practice before it. The Court of Criminal Appeals\n\nshall monitor cases assigned to the Emergency Appellate Division to\n\nensure a timely completion of cases assigned. Cases assigned to the\n\nEmergency Appellate Division shall be disposed of within ninety (90)\n\ndays after assignment or returned to the Court of Criminal Appeals\n\nfor further assignment resolution.\n\nC.
