Stat. tit. 20, § 20-91.7b","heading":"Business court judges — Appointment — Eligibility —","body":"Term.\n\nA. 1. Each business court shall consist of one business court\n\njudge to be appointed by the Governor with the advice and consent of\n\nthe Senate. If the Legislature is not in regular session when an\n\nappointment is made, the appointee shall assume the office on an\n\ninterim basis until the Senate takes final action to either confirm\n\nor reject the appointee. The Governor shall choose an appointee for\n\nany vacancy from a list of three candidates provided by the Speaker\n\nof the House of Representatives. If the Governor rejects all three\n\ncandidates, the Governor may request a subsequent list of candidates\n\nfrom the Speaker. The Speaker shall provide such subsequent list to\n\nthe Governor within forty (40) days of the request. If such\n\nsubsequent list is not provided, the Governor may appoint any person\n\nwho meets the qualifications set forth in paragraph 2 of this\n\nsubsection.\n\n2. To be eligible for appointment, a business court judge shall\n\nbe:\n\na. at least thirty-five (35) years of age,\n\nb. a United States citizen, and\n\nc. a licensed attorney in good standing in this state\n\nwith ten (10) or more years of experience in:\n\n(1) practicing complex civil business litigation,\n\n(2) practicing business transaction law,\n\n(3) serving as a judge or clerk of a court with civil\n\njurisdiction, or\n\n(4) any combination of experience totaling ten (10)\n\nyears as described by divisions 1 through 3 of\n\nthis subparagraph.\n\nB. 1. A business court judge shall serve a term of eight (8)\n\nyears, except as otherwise provided by this subsection, beginning\n\nSeptember 1, 2025, and may be reappointed. The first business court\n\njudge appointed to Business Court Division II shall serve a term of\n\nfour (4) years beginning September 1, 2025, and may be reappointed.\n\nA business court judge shall take the constitutional oath of office\n\nrequired of appointed officers of this state and file the oath with\n\nthe Secretary of State. A business court judge shall serve the full\n\nterm to which he or she was appointed and shall continue to serve\n\nuntil a replacement is appointed and assumes office.\n\n2. If a vacancy occurs in the office of a business court judge\n\ndue to death, incapacity, resignation, or impeachment, the Governor\n\nshall appoint a person to serve for the remainder of the unexpired\n\nterm in the same manner as the original appointment.\n\n3. Upon request by a business court judge, the Chief Justice\n\nmay appoint a district court judge to sit in designation temporarily\n\nas a business court judge to assist in caseload management.
