Stat. tit. 20, § 20-91.7c","heading":"Business court docket — Jurisdiction — Complex cases —","body":"Restrictions.\n\nA. In an action where damages are requested under subsection B\n\nor C of this section, the amount in controversy shall be at least\n\nFive Hundred Thousand Dollars ($500,000.00).\n\nB. When a business court division is created pursuant to\n\nSection 91.7 of Title 20 of the Oklahoma Statutes, certain cases,\n\nexcluding arbitration cases, filed on or after January 1, 2026, may\n\nbe assigned to the business court docket. The business court shall\n\nhave the power to grant any relief that may be granted by a district\n\ncourt and may exercise concurrent jurisdiction and the powers of a\n\ncourt of equity, to the extent that such powers are exercised.\n\nNotwithstanding the amount in controversy, where equitable relief is\n\nrequested in a business dispute, a business court may hear an\n\naction:\n\n1. Arising under the Uniform Arbitration Act, Section 1851 et\n\nseq. of Title 12 of the Oklahoma Statutes;\n\n2. Arising under the Uniform Commercial Code, Section 1-101 et\n\nseq. of Title 12A of the Oklahoma Statutes;\n\n3. Arising under the Oklahoma General Corporation Act, Section\n\n1001 et seq. of Title 18 of the Oklahoma Statutes;\n\n4. Arising under the Oklahoma Limited Liability Company Act,\n\nSection 2000 et seq. of Title 18 of the Oklahoma Statutes;\n\n5. Arising under the Oklahoma Revised Uniform Partnership Act,\n\nSection 1-100 et seq. of Title 54 of the Oklahoma Statutes;\n\n6. Arising under the Uniform Limited Partnership Act of 2010,\n\nSection 500-101A et seq. of Title 54 of the Oklahoma Statutes;\n\n7. Arising under the Oklahoma Uniform Securities Act of 2004,\n\nSection 1-101 et seq. of Title 71 of the Oklahoma Statutes;\n\n8. Arising under the Uniform Trade Secrets Act, Section 85 et\n\nseq. of Title 78 of the Oklahoma Statutes;\n\n9. Shareholder and unitholder derivative actions;\n\n10. That relates to the internal affairs of businesses\n\nincluding, but not limited to, rights or obligations between or\n\namong business participants regarding the liability or indemnity of\n\nbusiness participants, officers, directors, managers, trustees,\n\ncontrolling shareholders or members, or partners;\n\n11. Where the complaint includes a professional malpractice\n\nclaim arising out of a business dispute;\n\n12. Involving tort claims between or among two or more business\n\nentities or individuals as to their business or investment\n\nactivities relating to contracts, transactions, or relationships\n\nbetween or among such entities or individuals;\n\n13. For breach of contract, fraud, or misrepresentation between\n\nbusinesses arising out of business transactions or relationships;\n\n14. Arising from e-commerce agreements, technology licensing\n\nagreements including, but not limited to, software and biotechnology\n\nlicense agreements, or any other agreement involving the licensing\n\nof any intellectual property right including, but not limited to, an\n\nagreement relating to patent rights; and\n\n15. Involving commercial real property.\n\nC. A business court shall have jurisdiction to hear complex\n\ncases. For purposes of this act, “complex case” means an action\n\nthat requires exceptional judicial management to avoid placing\n\nunnecessary burdens on the court or the litigants, expedite the\n\ncase, keep costs reasonable, and promote effective decision-making\n\nby the court, parties, and counsel. In deciding whether an action\n\nis a complex case, the court shall consider factors including, but\n\nnot limited to, whether the action is likely to involve:\n\n1. Numerous hearings, and pretrial and dispositive motions\n\nraising difficult or novel legal issues that will be time-consuming\n\nto resolve;\n\n2. Management of a large number of witnesses or a substantial\n\namount of documentary evidence;\n\n3. Management of a large number of separately represented\n\nparties;\n\n4. Multiple expert witnesses;\n\n5. Coordination with related actions pending in one or more\n\ncourts in other counties, states, or countries, or in a federal\n\ncourt;\nfficult or novel legal issues that will be time-consuming\n\nto resolve;\n\n2. Management of a large number of witnesses or a substantial\n\namount of documentary evidence;\n\n3. Management of a large number of separately represented\n\nparties;\n\n4. Multiple expert witnesses;\n\n5. Coordination with related actions pending in one or more\n\ncourts in other counties, states, or countries, or in a federal\n\ncourt;\n\n6. Substantial post-judgment judicial supervision; or\n\n7. Legal or technical issues of complexity.\n\nD. An action is presumptively a complex case, subject to\n\nrebuttal, if it involves one or more of the following types of\n\nclaims:\n\n1. Antitrust or trade regulation claims;\n\n2. Intellectual property matters including, but not limited to,\n\ntrade secrets, copyrights, and patents;\n\n3. Securities claims or investment losses involving more than\n\ntwo parties;\n\n4. Environmental or toxic tort claims involving more than two\n\nparties;\n\n5. Ownership or control of business claims;\n\n6. Insurance coverage claims;\n\n7. Construction defect claims involving many parties or\n\nstructures;\n\n8. Product liability claims; or\n\n9. Mass tort claims.\n\nNothing in this subsection shall be construed to include individual\n\nconsumer claims or transactions involving a retail customer of goods\n\nor services who uses or intends to use such goods or services\n\nprimarily for personal, family, or household purposes; provided,\n\nhowever, this paragraph shall not be construed to preclude the court\n\nfrom exercising jurisdiction over mass actions or class actions\n\ninvolving such individual consumer claims.\n\nE. A business court shall have supplemental jurisdiction over\n\nany other claim related to a case or controversy within the court’s\n\njurisdiction that forms part of the same case or controversy. If a\n\nparty objects to the business court’s supplemental jurisdiction over\n\nother claims, the business court judge may remand those claims to\n\nthe district court.\n\nF. A business court shall not have authority to exercise\n\njurisdiction over claims arising under federal or state law, as\n\napplicable, involving:\n\n1. The Oklahoma Consumer Protection Act, Section 751 et seq. of\n\nTitle 15 of the Oklahoma Statutes;\n\n2. Against a governmental entity or political subdivision under\n\nTitle 19 of the Oklahoma Statutes or under The Governmental Tort\n\nClaims Act, Section 151 et seq. of Title 51 of the Oklahoma\n\nStatutes;\n\n3. Guardianship matters under Title 30 of the Oklahoma\n\nStatutes;\n\n4. Probate matters under Title 58 of the Oklahoma Statutes;\n\n5. A deceptive trade practice as set forth in Section 53 of\n\nTitle 78 of the Oklahoma Statutes, to the extent such matter is not\n\na business dispute;\n\n6. Residential landlord and tenant;\n\n7. Personal injury and wrongful death;\n\n8. Domestic relations;\n\n9. Foreclosures;\n\n10. Individual consumer claims or transactions involving a\n\nretail customer of goods or services who uses or intends to use such\n\ngoods or services primarily for personal, family, or household\n\npurposes; provided, however, this paragraph shall not be construed\n\nto preclude the court from exercising jurisdiction over mass actions\n\nor class actions involving such individual consumer claims;\n\n11. Collections in matters involving a corporation or other\n\nentity subject to the farming and ranching statutes of this state or\n\nan individual farmer; or\n\n12.
