Any commercial film and photographic print processor or\n\ncommercial computer technician who has knowledge of or observes,\n\nwithin the scope of such person's professional capacity or\n\nemployment, any film, photograph, video tape, negative, or slide, or\n\nany computer file, recording, CD-Rom, magnetic disk memory, magnetic\n\ntape memory, picture, graphic or image that is intentionally saved,\n\ntransmitted or organized on hardware or any other media including,\n\nbut not limited to, CDs, DVDs and thumbdrives, whether digital,\n\nanalog or other means and whether directly viewable, compressed or\n\nencoded depicting a child under the age of eighteen (18) years\n\nengaged in an act of sexual conduct as defined in Section 1024.1 of\n\nthis title shall immediately or as soon as possible report by\n\ntelephone such instance of suspected child abuse or child sexual\n\nabuse material to the law enforcement agency having jurisdiction\n\nover the case and shall prepare and send a written report of the\n\nincident with an attached copy of such material, within thirty-six\n\n(36) hours after receiving the information concerning the incident.\n\nFor the purposes of this section:\n\n1. \"Commercial film and photographic print processor\" means any\n\nperson who develops exposed photographic film into negatives,\n\nslides, or prints, or who makes prints from negatives or slides, for\n\ncompensation. The term shall also include any employee of such a\n\nperson but shall not include a person who develops film or makes\n\nprints for a public agency; and\n\n2. \"Commercial computer technician\" means any person who\n\nrepairs, installs, or otherwise services any computer including, but\n\nnot limited to, any component part, device, memory storage or\n\nrecording mechanism, auxiliary storage, recording or memory\n\ncapacity, or any other materials relating to operation and\n\nmaintenance of a computer or computer network or system, for\n\ncompensation. The term shall also include any employee of such\n\nperson.\n\nB. Any person who violates the provisions of this section, upon\n\nconviction, shall be guilty of a misdemeanor and shall be punished\n\nby the imposition of a fine not to exceed Five Hundred Dollars\n\n($500.00) or by imprisonment in the county jail not to exceed one\n\n(1) year, or both such fine and imprisonment.\n\nC.
